Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed theiewith, the High Court may be pleased to pass an order, direction or writ more particularly one in the nature of writ of mandamus declaring action of the Respondents more particularly the Respondent No.3 while. refusing to register the Sale Deed, Dated 06.11-.2025 presented by the Petitioners in respect of House on Plot No.95, consisting of Cellar and Ground Floor, admeasuring 203.50 sq.yds ot 170.14 sq.mts forming part of Sy.No.7414, situated at Vyjayanthi Colony, Mahendra Hills, East Marredpally, Secunderabad Cantonment as illegal, arbitrary and against the provisions of law and consequently direct the Respondent Nos. 2 & 3 to receive and register the Sale Deed, Dated 06.11.2025 presented by the Petitioners pertaining to the above property thereby to release the same in accordance with lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to DIRECT the Respondent Nos. 2 and 3 to receive and register the Sale Deed, Da.ted 06.11 .2025 presented by the Petitioners in respect of House on Plot No.95, consisting of Cellar and Ground Floor, admeasuring 203.50 sq.yds or 170.14 sq.mts forming part of Sy.No.7414, situated at Vyjayanthi Colony, Mahendra Hills, East Marredpally, Secunderabad Cantonment thereby to release the same Counselfor the Petitioners : SRI G RAJESHWAR REDDY Counsel for the Respondents: SMT. S. SRAVANTHI, AGP FOR STAMPS AND REGISTRATION The Court made the following: ORDER : l THE HONOURABLE SRI JUSTICE K.SARATH WRIT PETITION No. I ORDER: Heard learned counsel for the petitioners and Smt. S.sravanthi, rearned Assistant Government pleader for stamps and Registration appearing for the respondents and perused the material on record. With their consent, this writ petition is disposed of at the stage of admission itself.

It is the case of the petitioners that the respondents more particularly the respondent No.3 is refusing to register the Sale Deed, dated 06. 1 r.2o2s presented by the petitioners in respect of House on prot No.95, consisting of cellar and ground floor, admeasuring 203'50 square yards or LZo.r4 square meters forming part of Sy.No.74 /4, situated at Vyjayanthi colony, Mahendra Hills, East Marredpally, Secunderabad cantonment and also stated that the state Government - is claiming the subject property as ,Government rand, in 2 sK, J W.P.No.34140 of 2025 LGC No.167 of 1997 . Aggrieved by the action of the Registering Authority in not receiving and registering the subject document, the present writ petition is filed.
3. Learned Counsel for the petitioners further submits that the issue involved in this matter is connected with ' by the State W. P. No . 1 9 1 06 of 20 lO , which is filed Government against the order in LGC.No .L67 of 1997 passed by the Special Court under the A.P. Land Grabbing (Prohibition) Act, 1982, Hyderabad and the sarne was dismissed by the Division Bench of this Court on 28.05.2025. Therefore, learned counsel requested to allow the writ petition by directing the respondent No.3- Sub-Registrar to register and release the sale Deed presented by the Petitioners.

On the other hand, the learned Assistant Government Pleader for Stamps and Registration has not disputed the submission made by the learned Counsel for the petitioners. -Jb,*ir;&e;.-,, \\ \ 3 SK, J W.P.No.3414O of 2O2S b In view of the submissions made by both the sides and in view of dismissal of the w.P.No.19106 of 2010 on
28.05.2025, th,e writ Petition is disposed of directing the respondent No.3/Sub-Registrar to receive, register and release the document presented by the petitioners in respect of subject property without reference to LGC No. 167 of L997 , subject to the petitioners complying with the provisions of the Indian Registration Act, 19og and the Indian Stamps Act, 1899. It is also open to the Registering Authority to refuse the document presented by the petitioners, if any other objection, by duly assigning the reasons and communicate the sarne to the petitioners.

It is made clear , that mere registration of the document does not confer title on the subject property and it is also made clear that this order would not have any bearing on all those matters where tit\e / rights of the parties are pending before the authorities either in revision /appeals for adjudication and in any other cases. 4 SK, J w-P.No.34140 ot2025 This ord.er also does not preclude the parties in asserting their rights before a competent Court of law.
