S.Sravanthi, learned Assistant Government pleader for Stamps and Registration appearing for the respondents and perused the material on record. With their consent, this writ petition is disposed of at the stage of admission itself.

Aggrieved by the action of the Respondent No.4 and 5, more particularly Respondent No.5 in refusing to receive and register the Sa-le Deed of the petitioner in respect of agricultural land in Survey No.4O9/ l, admeasuring Ac.3.30 g.rntas, situated at Mothkur Village and Gram panchayat, Doma Mandal, Vikarabad District, without considering the Legal Notice dated 2l .O8.2O25 and also representation dated I4.O7.2O25, the petitioner filed the present writ petition.

Learned Assistant Government pleader for Stamps and Registration submits that the respondents will receive the document presented by the petitioner vide Slot Booking SK, J W.P,No.34658 o! 2O25 No.2500327546 dated 17.O5.2025 and No.2500327584 datecl 17.05 2025 artd process the same or lollow the proccdure c,ontemplated under Section 7I of the Registration Act. 1908 (for short, 'the Act, 1908) for rejecting the samr:.

The Section 71 of the Act, 1908, reads as follows: Re:rsons for rcfusal to register to be rccorded.- (1) Evcry Sub-Regrstlar refustng to register :l dor:untcnt, cxcept on the ground that the property to ',r.hich it rclales is not situated rvithin his sub- district shall make an order of refusal and recordecl his reasons for such order in his Book No.2, ancl enrlorse the q,ords "rcgistration refused" on thi: docrrr-ncn t; and, on application made by ilny pcrsolt exccul ing or claiming under thc document, shall, without payment and unnccessary delay, give him a cop1. ol thc rcasons so recorded. (2) No registcring olficer shall acccpt for registratiorr a clocumen, so cndorsed unlcss and until, under thc provisions hcreinaftcr conLained, the document is dirt:ctcd to be registercd.

In vieu, of the above made submissions coupled with the provision under Section 71 of the Act, 1908, this writ petition is disposed of directing the Registering Authority to 3 SIr, J W.P.No.34656 of 2O25 receive, register and release the subject document presented by the petitioner vide Slot Booking Slot Booking No.25OO327546 dated 77.O5.2O25 and No.25O0327584 dated 17.05.2025 in respect of the subject property, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registered. There shall be no order as to costs.
