Judgment
DATED:07-12-2010 This petition is filed under Section 482 of Cr.P.C. for quashing the proceedings in Cr.No.162 of 2010 of Chikkadpally police station, Hyderabad.
Petitioners-A1, A3, A5 and A6 and the 2nd respondent-
complainant are present. Sri B.G.Ravindra Reddy, learned counsel for the petitioners, and Sri M.Sreenivasulu, learned counsel for the 2nd respondent-complainant, are present.
A joint memo has been filed by both parties stating that they have settled the matter outside the Court and hence, 2nd respondent–complainant is no longer interested in prosecuting the petitioners-A1, A3, A5 and A6 in Cr.No.162 of 2010 of Chikkadpally police station, Hyderabad. The terms of compromise, which are stated in the joint memo filed by the petitioners and the 2nd respondent, are placed on record.
Having regard to the fact that the matter has been settled out side the Court and both parties have entered into memorandum of understanding and the 2nd respondent-complainant is no more interested in prosecuting criminal proceedings against petitioners, it is considered that no useful purpose would be served by continuing further proceedings in Cr.No.162 of 2010 of Chikkadpally police station, Hyderabad against the petitioners-A1, A3, A5 and A6. It is therefore considered a fit case to invoke inherent powers of this Court under Section 482 Cr.P.C. to quash further proceedings against the petitioners-A1, A3, A5 and A6 in Cr.No.162 of 2010 of Chikkadpally police station, Hyderabad.
In the circumstances, further proceedings in Cr.No.162 of 2010 of Chikkadpally police station, Hyderabad, against the petitioners-A1, A3, A5 and A6 are held liable to be quashed and are accordingly quashed.
