2. This application under Section 11(5) and 11(6) of the Arbitration and Conciliation Act' 1996 has been filed seeking appointment of an arbitrator to adjudicate the dispute between the parties. J Admittedly, the parties have entered into an Agreement for Sale dated 15.Og.2O22' Learned counsel for the applicant drawn the attention of this Court on the arbitration clause which reads thus: "1O. 4. When the dispute has arisen between the parties' the applicant got issued a legal notice dated 2a'lo'2o24 j^tn' respondents for appointment of Arbitrator' but the same could ot fetch anY result. 2

5. Nobody has entered appea-rance for the respondents ,a) despite seilice of notice. It appears that there exist disputes between the parties which need to be resr_rlved through Arbitration procedure, as per the dispute resolution clause. 6. Ear,lier, in A.A. No. 99 of 2O24, wherein thr.: respondents are the seurle as those in the current application, t.his Court, by an order dated 11.O7.2O24, appointed Dr. Justice Shameem Akhter, a former Judge of this Court, as the sole arbitrator to adjudicate the disputes between the parties. 7 Therefore, in the instaat case aJso, Dr. Justir:e Shameem Akhter, a tlormer Judge of this Court (resiclent of Flat No.6F, Sixth Floor, Mal.air Apartment, Block_B, H.No.g_2_ 269/3/MF/F-6, Road No.2, Banjara Hills, Sri Nagar Hyderabad_35; Mobile No.833199g534), is appoinr_ed arbitrator to adjudicate the dispute between the parties. as sole Colony, 8 The p:rrties sha.ll appear before the sole arbitrator on O5.O4.2O25 at 11:OO a.m. along with a copy of l.his order. l.he sore arbitrator shall proceed with the arbitral Thereupon, proceedings in accordalce with law. 3 Accordingly, the Arbitration Application is allowed' No 9 costs.
