NO: 1OF 2016(W PMP. NO: 1272OF 20161 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 5th respondent to examine and sponsor the names of the petitioners for appointing as Junior Plant Attendants in Kothagudem Thermal Power Station, Palvoncha, Khammam District under land loser quota forthwith as per Government Orders and Judgement of Hon'ble Supreme Court of lndia and as well as Judgements of this Hon'ble Court, pending disposal of the Writ Petition. Counsel for the Petitioner : SRI G.ALLABAKASH Counsel for the Respondents: SRI SRIKANTH (SC FOR TSGENCO) The Court made the following: ORDER 1 wp 1033_2016 NBK, J THE HON'BLE SRI JUSTICE NAG ESH BHEEMAPAKA WRIT PETIT ION No.1033 of 2O16 ORDER: The case of the petitioners, as per the writ affidavit, is that they are dependents of families whose lands have been acquired by the Govemment for constructing Northem Ash Pond for Kbthagudem Thermal Power Station (KTPS), Paloncha in the year 2009, with an assurance of employment under "Land Loser Quota" under G'O'Ms'No'98 dated 15.04.,l986. The petitioners approached the 5th respondent-District collector, Khammam, and submitted representations dated 07.12.2015 to appoint them as Junior Plant Att'endants in KTPS, however, no action has been taken on their represenfations till date; hence, this writ petition'

3. A detailed counter aflldavit has been fited by the Deputy Secretary (O&M), TS GENCO on behalf of respondent Nos'l to 4' In response' a Reply affrdavit has been filed by the counsel for the petitioners'

Having considered the respective submissions and perused the record, the averments in paragraph No. l0 of repty affidavit would disclose that petitioner Nos.2, 3, 4, 6, 7, and 8, who earlier worked on Contract basis have subsequently been absorbed into the service of the organization. This factum of absorption is not disputed by both the leamed counsel. Further, it may be noted that though some representations are annexed at Page Nos.32 to 52 of the writ material papers, they do not contain any L 2 wp_1033 2016 NBK, ] receipt/acknowledgment to infer that they have in fact been submitted beFore the respondent authorities to enable them to examine their cases. Leamed counsel for the petitioner filed a Memo dated 23.06.2025

5. (i.e., today) enclosing a representation dated 07.12.2015 of Mr. J. Prasad (9th petitioner herein) requesting the 5th respondent-District Collector to provide employment as Junior Plant Attendant under the Land Loser Quota. ln that view of the rnatter, the 5m respondent-District Collector is directed to forthwith consider the case of 9th petitioner for appointment as Junior Plant Attendant. The plea of petitioner Nos.l to 8 for appointment as Junior Plant Attendant is dismissed.

6. Accordingly, the writ'petition is partly allowed. No costs.
