The learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, placed on record instructions issued by Sub-Inspector of Police, Cyber Crime Police Station, Hytlerabad, wherein it is subrnitted that on 08.07.2025, on behalf of one Mr.Pradeep Sadineni, a USA resident Sri.Charan Kumar, lodged a complaint, stating that one Sreekanth Musini assured Pradeep Sadineni, that he would arrange loan for USD 5 Million and trusting him, Pradeep Sadineni, transferred Rs.75,72,985.35 from his ICIC Bank to the account of Sreekanth Musini. Later, despite rep-ea,tqd -f9-lleul-ups, '* -* ./ 'i------l= no Ioan \vas arranged, hence, the comprainant was made. on sucrr compraint, FIR No.-1220 of 2025 was registered under section 66 c, D ITA Act and sections *19,420,120 B read witrr 34 Ipc. During the course of enquiry, it was revealed that through srikant Musini account, the victim,s lost amount \^,as transferre'd to petitioner's account, hence, the petitioner custody is necessary to recove'the rost amount and to proceed further in the case. 4' Le:rrned Assistant Government preader for Home submits that the petitioner is arrayed as accused No.2 in FIR No.12 20 of 2025 and since the petitioner is absconding, the respondent authorities could not serve notice under secl;ion 35(3) on the petitioner. It is further subrnitted that the petitioner instead of co-operating with the pending investigation had filed this writ petition. 5' At this stage, Iearned counsel for the petitioner fairly submits that the petitioner rvould approach the concerned police station and pray this Court to direct the :'espondent authorities to follow due procedure as co.ternprated under law 6' llecording the submissions made by rearned counser appearing on e'ither side' without expressing any opinion on the merits of the case a.d since the investigation is pending in FIR No.1220 of 202s, trris court cleems it appropriate to dispose of the writ petition directing respondent auth.rities to follow due p'r6ggdure as contemplated under law for further course of actio^.
