This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Ramya Kumari Gudiseva, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent No. 1 and of None appeared for the Respondent No. 2. The Court made the following: ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA l.A.Nos.1 &2of 2025 in/and CRIMINAL PETITION No.14446 of 2025 COMMON ORDER: 1. This Criminal Petition is filed under Section 528 of BNSS, 2023 seeking to quash the proceedings against the petitioners/accused Nos.1 to 4 in C.C.No.608 of 2024, pending on the file of ll Additional Judicial Magistrate of First Class, at Nagar Kurnool, registered for the offences punishable under section 498-A of lPC, 1860 and Sections 3 & 4 of DP Act.
2. lt is submitted by learned counsel for the petitioners/accused Nos.1 to 4 as well as respondent No.2 that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos.1 & 2 of 2025 have been filed by respondent No.2/defacto complainant seeking permission to compound the offences, to record compromise and to quash the proceedings against the petitioners in the above crime.
3. The learned Additional Public Prosecutor has opposed the compromise petition. 2 EfqJ LA.Nos.7 &2 ol 2025 in/ond Crlp.No14445 of 2025
4. Since the parties were willing to enter into compromise, they were given a chance to settle the matter by appearing along with their respective counsel before the High Court Legal Services committee for the state of Telang ana vide orders dated 07 .11 .zo2s passed by this court. The secretary, High court Legal services Committee shall identify the parties and submit a report to that effect.
5. Pursuant to the above said direction issued by this court, the parties along with their respective counsel have appeared before the High court Legal services committee for the state of relangana and the Secretary of the above said Authority identified the parties and submitted a report dated 12.11.202s stating that the parties were identified and they have willfully, without any coercion, entered into compromise.
6. ln view of the above, l.A.Nos.1 & 2 of 2o2s are allowed. consequently, the criminal Petition is allowed and the proceedings in c.c.No.60B of 2024, pending on the file of lt Additional Judicial Magistrate of First class, at Nagar Kurnool, are hereby quashed subject to the petitioners paying an amount of Rs.s,000/- (Rupees FivelThousand only) to the Telangana High Court Bar Association, \ Hyderabad and Rs.s,000/- (Rupees Five Thousand only) to the High court Legal services committee for the state of relangana, within a 3 EfD,T ,.A.No'.1 &2 ol2025 tn/ond Crlp.No74446 ol 2025 period of two (02) weeks from today and file proof of the same before the Registry.
