19.11 .2012 to the petitioners calling upon them to produce the ou,nership documents of their respective propefties and further rntimating thern that thcir propertics woultl be aft.ected in rhc proposccl road widening from Ekrninar junction to Bazarghatt junction including Slip road/Ekminar junction irnprovement. Learned senior counsel further submitted that thc respondents have not initiated any proceedings for acquisition of the respective properlies of the petitioners and have straightaway issucd notices to the petitioners to produce the ownership documents, which is contrary to the settled principle of law. By contending thus, learned senior counseI submitted that if the respective properties of the 3 LNA, J WP.No.34896 of 2014 ahd batch petitioners are required for the proposed road widening, the respondents-GHMC rnay be dirccted to follow duc process of larv for acquisition and prayed to allow the Writ petitions.
5. Learned Standing Counsel lor respondents_GHMC submitted that if the respective properties ol the petitioners are required for the proposed road widening, the respondents would initiate appropriate procecdings lor acquisition of sarne in accordance with law.
6. Right to property is a constitutional right and no person shall be deprived of his,iher propcrty, however, the Governmcnt can acquire private property il the same is required for public purpose(s), by following due lcgal process.
7. ln view of the same and recording the submissions of the leamed Standing Counsel lor respondents_GHMC, these Writ Petitions are disposed of, directing the respondents_GHMC not to interfere with the respective properties of the petitioners except in accordance with the procedure contemplated under law. 4 LNA, J 11P.No.3,1896 ol20l1 and butch L Nlisccllancous petitrons pending, if uny, shall stand closcd.
