JUSTTCE T. MADHAVI DEVI ORDER: WRIT PETITION No.33483 OF 2025 In this writ petition. the petilioners are challenging the action of respondents No.2 and 3 in issuing Proceedings No. Rev/G1/LAG/0O16 / 2020-G-Section, dt.04.10.2025 and the consequential Demand Notice No.B/963212025 dt. 13.1O.2O25 to the farmers o[ Polepally Grampanchayat, as illegal and arbitrary.
2. Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Ra.i appearing for respondents No. I and 2 ar-d the learned Government Pleader for Revenue appearing for respondent No.3.
3. Briel facts leading to the filing of the writ petition are that petitioners are ail farmers r,r,ho have been paid compensation allegedly I for acquisrtion of their lands. Subsequently, there was an enquiry conducted by Revenue Divisional Offrcer (RDO) and it was observed that the subject lands which were acquired and for which compensation was paid are not patta lands, but are Governmcnt lands. Therefore, it was observed that the compensation was paid illegally and there was a proposal to recover the said payments from the recipienl farmers. Dependrng on the report of the RDO, the impugned demand notice has been issued. Challenging the same, the present wrir pedtion is lrled. {_- ')
4. lcarned Government Pleader for Revenue has forwarded the copy of the instructions received by him, according to which, the decision has been taken to recover the compensation paid to the petitioners herein. But there is no reference to any show cause notices issued to the petitioners before issuing the demand notice, which is in violation of the principles of natural justice.
5. In view thereof, the impugned demand notice is set aside with liberty to the respondent authorities to issue show cause notices to the farmers to whom payments have been rnade itlegally and consider their explanation, if any and thereafter take action in accordance with law.
6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending in this writ petition stand closed. //TRUE COPY// SD/. K.
