Learned Standing Counsel for Central Gover lment submits that a criminal case vlde C.C.No 1003 of 2022, ott the file of the learned ll Additional Junior Civil Judge-cum-Vl Adcrtional Judicial lvlagistrate of First Class. Medchal-ttlalkajgiri, is penl ng against the petitioner and therefore, refusal to issue passp{) t as per the Passport Rules cannot be said to be illegal.

Be that as it may, considering the judgmenl of lhe coordinate Bench of this Court in W.P.No.35056 of 2023, dated t 2.01 2024 and the purpose for which the passport is being re(lr ested by the (' / I petitioner, this Court directs respondent No.2 to issue the passport to the petitioner on the following conditions i) The petitioner herein shall submit an undeftaking along with an affidavit in C.C.No 1003 of 2022, on the file of the learned ll Additional Junior Civil Judge-cum-Vl Additional Judicial Magistrate of Frrsf C/ass, Medchal-hrlalkajgiri, stating that he shall not leave lndia during pendency of the said C.C. without permission of the Court and that he shall cooperate with trial Court in concluding the proceedings in the said C.C ii) On filing such an undeftaking as well as affidavit, the trial Courl shall /ssue a ceftified copy of the same within two (2) weeks therefrom iii) The petitioner herein shall submit an application afresh along with ceftified copy of this order as well as the aforesaid undeiakng before the Passpori Officer / Authority concerned for issuance of passport; I iv) On filing such an application, the Passport Officer/ Authority shall consrder the same afresh in the light of the observations made by this Court herein as well as the contents of the undertaking given by the petitioner for lssuance of passpod, in accordance with law, within three (03) weeks from the date of said application; v) On issuance of the passport, the petitioner t;'=rein shall deposit the same before the trial Courl in C C L1o.1003 of 2022 , vi) However, libefty is granted to the petitioner I't'rein to file an application before the learned Ma.gistrat t seeking permission to travel abroad and it is for lt '= learned Magistrate to consider the same in accordance t. r ih law 6 Accordingly, the Writ Petition is disposed of.
