JUDGMENT:
(per Hon’ble Sri Justice VILAS V. AFZULPURKAR) Since the appeal is preferred against the interlocutory order passed by the learned single in WVMP No.3951 of 2008 and WPMP No.33348 of 2008 in WP No.16196 of 2008, dated 17.12.2008, We have heard both the learned Counsel. On the earlier occasion, when the matter was heard, we had directed the learned Counsel for the respondents to file an affidavit affirming that the 2nd respondent, while functioning as correspondent, shall undertake to function without giving any scope to make any comments against the discharge of her functioning and she will strictly implement the directions of the District Educational Officer. An affidavit accordingly has been filed by the 2nd respondent, which is taken on record. The order impugned in the writ appeal notices that the order of removal of the 2nd respondent from the office of Correspondent, which is impugned in the writ petition, was kept in abeyance by this Court by order, dated 25.7.2008 and later the impugned order is passed, while making the said interim order absolute. It was further directed that the 2nd respondent herein shall be allowed to continue as Correspondent under the control of the District Educational Officer, Kakinada, East Godavari District and the 2nd respondent shall furnish the details of working pattern to the District Educational Officer once in a week i.e., on every Friday and shall abide by the directions of the District Educational Officer regarding smooth administration of the school. In view of the fact that the affidavit of the 2nd respondent, as directed, is filed as referred to above, nothing further survives to be considered in this appeal. Subject to the observation as above, the writ appeal is dismissed confirming the orders of the learned single Judge dated
