This Petil.ion coming on for hearing, upon perusing the Memorandum of Grounds of tlriminal Petition and upon hearing the arguments of Sri Malchalmre i-{ari Vastav, Advocate for the Petitioner and the Additional Public Prosecutor on tlehalf of the Respondent No.1 and of Sri Hari Chandra Aditya, Advocate on behalf of the Respondent No.2. The Gourt made the following: COMMON ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA l.A.Nos.2 and 3 of 2025 in/and COMMON ORDER: This Criminal Petition is filed by the petitioner/accused under Section 528 of BNSS, 2023 seeking to quash the proceedings against him in FIR No.1O57 of 2025 on the file of Rajendranagar Police Station, Cyberabad registered for the alleged offence punishable under Sections 109(1) and 85 of BNS.
2. tt is submitted by learned counsel for the petitioner as well as respondent No.2 that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos-2 & 3 of 2025 have been filed by respondent No.2 to record compromise between them. The FIR was registered for the alleged offence punishable under Sections 109(1) and 85 of BNS against the petitioner herein. However, the affidavit filed by the victim discloses that the complaint was made in a fit of anger and misunderstanding and that there Was no intention on the part of her husband to cause any harm to her. However, the differences have been resolved and they amicably decided to maintain peace and harmony. Therefore, she submitted a letter dated
15.10.2025 to the concerned sHo expressing her decision to withdraw the comptaint and requesting the authorities not to pursue the matter , .I I I J] i ! Ii' I 2 ETD. J l.A.Nos.z & 3 of 2025 iiland Cdp.No.l 4596 of 2025 further, following which the present compromise petition has been filed. ln view oF the same, since the allegations under 109(1) of BNS are intended tr: be withdrawn by the defacto complaint, the alleged offence punishable under section Bs of BNS is compoundable. Hence the compromise is recorded.
3. The learned Additional public prosecutor has opposed the compromis,e petition

The c'efacfo complainant and the accused are wife and husband. since the parties were willing to enter into compromise, they were given a chance to settle the matter by appearing along with their respective counsel befirre the High Court Legal Services Committee for the State of Telangana v,ide orders dated 11.11.202s passed by this court. The Secretary, High Court Legal Services Committee shatl identify the parties and submit ar report to that effect.

Pursuant to the above said direction issued by this court, the parties along with their respective counsel have appeared before the High court Legal services committee for the State of relangana and the Secretary of the above said Authority identified the parties and submitted a report dated 19.11.2025 stating that the parties were identified and they have willfully, without any coercion, entered into compromise. \ -/ 3 ET'D, J l.A.Nos.2 & 3 d 2025 in/and Cdp-No.14596 ot 2025

In view of the above, l.A.Nos.2 and 3 of 2025 are allowed Consequently, the Criminal Petition is allowed and the proceedings in FIR No.1057 of 2025 on the file of Rajendranagar Police Station, Cyberabad, registered against the petitioner/accused are hereby quashed subject to the petitioner/accused is paying an amount of Rs.5,000/- (Rupees Five Thousand Only) to the Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad and Rs.5,000/- (Rupees Five Thousand Only) to the Director, Sainik Welfare, Hyderabad (Savings A/c.No.52188926279, State Bank of lndia, Shantinagar Branch (20070), IFSC Code:SB1N0020070, MICR No.500004057), within a period of two (02) weeks from today and file proof of the same before the Registry. 7.
