Acting the interests of justice and equity This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Sainath B, Advocate for the Petitioners in Crl.Petition and Respondent Nos.2 to 4 in LA.Nos.2 and 3 of 2025 and the Additronal Public Prosecutor on behalf of the Respondent No.1 in Crl.Petition and in l.A.Nos.2 and 3 of 2025 and of Srr Anand Masna, Advocate for the Respondent no.2 in Crl.Petition and Petitioners in I A.nos.2 and 3 of 2025. The Court made the following: ORDER I I I / / THE HON'BLE SMT. JUSTICE TIRUMALA DEVIEADA l.A.Nos.2&3of2025 in/and CRIMINAL PETITION No.14202 ot 2025 COMMON ORDER: 1. This Criminal Petition is filed under Section 528 of BNSS, 2023 seeking to quash the proceedings against the petitioners/accused Nos.l to 3 in Crime No.145 of 2025, on the file of Kagaznagar-Town Police Station, Kumrambheem Asifabad District, registered for the offence punishable under sections 498-4 of lPC, 1860 and Sections 3 & 4 of DP Act.

2. lt is subrnitted by learned counsel for the petitioners/accused Nos.1 to 3 as well as respondent No.2 that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos.2 & 3 of 2025 have been filed by respondent No,2/defacto complainant seeking permission to compound the offences, to record compromise and to quash the proceedings against the petitioners in the above crime.

4. Since the parties were willing to enter into compromise, they were gaven a chance to settle the matter by appearing along with their respective counsel before the High Court Legal Services Committee for the State of Telangana vlde orders dated 03.1 1.2025 passed by this Court. The Secretary, High Court Legal Services Committee shall identify the parties and submit a report to that effect

Pursuant to the above said direction issued by this Court, the parties along with their respective counsel have appeared before the High Court Legal Services Committee for the State of Telangana and the Secretary of the above said Authority identified the parties and submitted a report dated 12.11.2025 stating that the parties were identified and they have willfully, without any coercion, entered into compromrse.

6. ln view of the above, l.A.Nos.2 & 3 of 2O25 are allowed. Consequently, the Criminal Petition is allowed and the proceedings in Crime No.145 of 2025, on the file of Kagaznagar-Town Police Station, Kumrambheem Asifabad District, are hereby quashed subject to the petitioners paying an amount of Rs.5,0001 (Rupees Five,Thousand Only) to the Telangana High Court Bar Association, Hyderbbad and Rs.5,000/- (Rupees Five Thousand Only) to the High Court Legal Services Committee for the State of Telangana, within a .,-,. It is submitted that the above petition was filed to quash the proceedings against the petitioner/accused Nos. 1 to 3 in Crime No.l45l2O25 on the file of Kagaznagar -town Police Station, Kumrambheem Asifabad District for the offences U/s 498(.{),3&4D.P.Act, 2. As both the parties have come to an understanding, as initial misunderstandings and misgivings were sorted out amicably, and therefore, the 2nct Respondent/Defacto complainant, is not interested to prosecute the petitioners arry longer in view of the settlement and compromise arrived at between the parties herein. /) r) It is submitted that, the Memorandum of compromise memo for recording lull and final Settlement Settlement of Rs.5,O0,OOO/-(Five Lakh rupees ) to 2nd respondent/defacto complainant shall be given by 1"t Petitioner/Al as full and final settlement . petitioners /Accused Nos.l to 3 and the defacto-complainant agreed the same and to mutual divorce between the l"t petitioner/Accused No. 1 and Defacto-complarnantf 2d respondent for dissolve of the marriage was performed on 2l-O4-2O22.. Now bottr parties came forward to a settlement as under this terms and conditions.

4. It is submitted that, after the settlement, the 2d respondent/Complainant should never file any Civil and Criminal cases against t1le petitioners/Accused and his family members. The 2"d respondent/ Complainant should never interfere in the petitioners/ Accused and his family member's life and Petitioner/Complainant would not have any rights to the properties of the petitioners/Accused and his family members. It is submitted that, the 2"d respondent/Complainant 5. agrees to give divorce to the petitioner No. 1/Accused No. 1 without any conditions. The 2"d respondent/Complainant is agreed to the above-mentioned terms and conditions for her permanent alimony of her entire life. If anyone of the both parties violate or breaks thc conditions meritioned in this compromised memo then legal action would be taken against the violated party.

6. This Compromised memo is the full and final settlement of the both parties. Therefore, the joint memo of compromise is being hled seeking permission of this Hon'ble Court, to compound the offence and to record the compromise and to quash the proceeding in the above Crime No. 145/2025 on the file of Kagaznagar -town Police Station, Kumrambheem Asifabad District for the offences U/s a98(A), 3 & 4 D.P. Act, It is therefore prayed ttrat the Hon'ble Court may be pleased to receive the joint memo of compromise and to permit the petitioners and the 2"d respondent to compound the offence in the interests of justice and equity. !
