This Writ Petition is filed seeking a direction to respondent No.1 to consider the application of the petitioner submitted for reissuance of Passport bearing No.Ll2'13566 without reference to pending Criminal Case vide C.C.No.8933 ot 2022, on the file of the learned Xlll Metropolitan Magistrate, Manoranjan Complex, Hyderabad.

2. Heard Ms.S.Sumalatha, learned counsel for the petitioner and Sri N.Bhujanga Rao, learned Deputy Solicitor General of lndia representing respondent Nos.1 & 2. Perused the record. 2 -I

3. Learned counsel for the petitioner subrr ts that mere arraignment of the petitioner in a criminal case canr rt be a ground for denial of passport. He relies on the judgment r f this Court in W.P.No.24690 ot 2025, dated 03.09,2025.

Learned Standing Counsel for Central Gove r rment submits that a criminal case was registered against the retitioner vide C.C.No.8933 of 2022, on the file of the learned )l I Metropolitan Magistrate, Manoranjan Complex, Hyderabad, for the offences punishable under Sections 4984, 323 and 506 IPC zrr d Section 3,4 & 6 of Dowry Prohibition Act and therefore, refusal tc ssue passport as per the Passport Rules cannot be said to be illegal.

5. Be that as it may, considering the judgment of I re Coordinate Bench of this Court in W.P.No.35056 of 2023, dated {) ,..O1 .2024 and the purpose for which the passport is being reqr-:sted by the petitioner, this Court directs respondent No.2 to issr-t the passport to the petitioner on the following conditions: i) The petitioner herein shall submit an undertet ,ng along utith an affidavit in C.C.No.B933 of 2022, on the 'ite of the learned Xltl Metropolitan Magistrate, Manoranjar, )omptex, Hyderabad, stating that he shall not leave lnc;a during pendency of the said C.C. without permission ot he Court l and that he shall cooperate with Trial Courl in concluding the proceedings in the said C.C. ii) On filing such an undertaking as well as affidavit, the Trial Court shall lssue a ceftified copy of the same within two (2) weeks there from; iii) The petitioner herein shall submit an application afresh along .with certified copy of this order as well as the aforesaid undertaking before the Passport Officer/ Authority concerned for issuance of passport; iv) On filing such an application, the Passport Officer/ Authority shall consider the same afresh in the light of the observations made by this Court herein as well as the contents of the undeftaking given by the petitioner for lssuance of passport, in accordance with law, within three (03) weeks ftom the date of said application; v) On issuance of the passpotl, the petitioner herein shall deposlt the same before the Trial Court in C.C.No.8933 of

2022. vi) However, liberty is granted to the petitioner herein to file an application before the learned Magistrate seeking permission to travel abroad and it is for the learned Magistrate to consider the same in accordance with law. r- 4

6. Accordingly, the Writ Petition is disposed of. Tl _.re shall be no order as to costs.
