VIJAYSEN REDDY WRIT PETITION No.32910 OF 2025 ORDER: (oRAL) This writ petition is filed by the petitioner seeking to declare the action of respondents No.3 and 4, in interfering with his possession over the land admeasuring Acs.2-00 guntas ln Survey No.257, situated Inumamula Village, Hanumakonda Mandal, Warangal District, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. Sunkari Vamshi Krishna, leamed counsel for the petitioner; Mr. Pasham Mohith, leamed Standing Counsel tbr GWMC (Greater Warangal Municipal Corporation), appearing for respondents No.2 to 4; and perused the material on record.

The petitioner claims to be the owner of the land admeasuring Acs.2-00 guntas in Survey No.257, situated Inumamula Vitlage, Hanumakonda Mandal, Warangal District, having purchased the same from its previous owner under registered sale deed dated I 1.02.2000 It is stated that the petitioner instituted,a suit in O.S. No.9l5 of 2019 on the file of the leamed I Additional Senior Civil Judge, Warangal and W.P. No. 1089 of 2020 on the file of the leamed Senior Civil Judge, Warangal against third parties who are trying to interfere with his 2 possession. tt is further stated that as there was interfererc : by the Police with the possession of the petitioner in respect of the su rject propertY, W.P. No.31260 of 2023 was hled before this Court anC the same was disposed of by the order dated l0.ll-2023 directing the rt't pondent Police not to interfere with the possession of the petitioner irr respect of the subject property. While so, at the instance of the third parties, respondents No.3 and 4 visited the subject property on '.7.10.2025 and directed the petitioner to vacate the subject propertl'' As there is interference by the respondents No.3 and 4 with the pc ;session of the petitioner in respect of the subject propefty, he is constrai: Led to approach this Court.

Learned Standing Counsel for GWMC submitted hat there is no interference by the respondent authorities with the p'r;session of the petitioner in respect of the subject property as alleged br him in the writ affidavit. On inspection done by the respondent authori'i:s, it was found that structures existing in the subject property claimed t y the petitioner are in possession of the private parties against whom the: bove suits were filed and they are necessary parties to this /rs. 3

However, without expressing any opinion on merits, recording the submission made by the leamed Standing Counsel for GWMC that there is no interference by the respondent authorities with the possession ofthe petitioner in respect of the subject properry, this writ petition is. disposed of directing respondents No.2 to 4 not to interfere with the possession of the petitioner in respect of the land admeasuring Acs.2-00 guntas in Survey No.257, situated Inumamula Village, Hanumakonda Mandal, Warangal District, without following due process of law. This order, however, shall not have any bearing on the disputes regarding title and possession between the petitioner and third parties in respect ol the subject property. There shall be no order as to costs.
