2. None appeared on behalf of the petitioners.
3. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos-1 to 5. 2
4.1. Leerrned Assistant Government Pleader for Home submits that, based on the representations of the de facto complainants, who are employee's of Al-Arif Unani Medical College, Chandrayanagutta, Bandlaguda, Hyderabad, Crime Nos. 32 of 2018 and 358 of 2014 were registered. Subsequently, these cases were transferred to the Court of the Xll Additional Chief Metropolitan Magistrate, Hyderabad. Thereafte', the investigation was taken over by the Central Crime Station (CCS), which renumbered the said crimes as Crime Nos. 597 of 2015, 50 of 2023, and 5834 of 2019, respectively.
4.2. lt is further submitted that, in Crime No. 597 of 2015, the accused rl/ere tried, convicted, and sentenced to two years of imprisonment with a fine of Rs.1,000/- by the learned Xll Additional Chief Metropolitan Magistrate, Hyderabad. The other two crimes, namely Crime Nos. 50 of 2023 and 5834 of 2019, are still pending trial before the competent Court. Additionally, it is submitted that the petitioners herein are neither the de facto complainants nor the accused in any of the said cases. Therefore, the request made by the petitioners for directing a transfer of investigation to the Crime Branch-CID (CB-ClD) is wholly misconceived and without any basis.
4.3. lt is further contended that, since the connected criminal cases are already at the stage of trial before the competent Court, seeking . transfer of rnvestigation at this juncture would be both inappropriate j j 1 t,_'' i 3 and impermissible in law. Hence, the learned Assistant Government Pleader prays for dismissal of the writ petition.
5. I have perused the material available on record.
6. The contention of the petitioners is that, to ensure an impartial investigation and trial against respondent Nos. 6 to 9 in the pending crimes, the investigation ought to be transferred to the CB-CID- However, the record, coupled with the submissions of the learned I I Assistant Government Pleader for Home, clearly establishes that the petitioners are neither the de facto complainants nor otherwise connected to the pending criminal proceedings. Furthermore, it is , I evident that the investigation in the concerned crimes has already been completed, charge sheets have been filed, and the matters are presently pending for trial before the jurisdictional Court. ln the absence of any specific material indicating bias, mala fides, or procedural impropriety on the part of the investigating agency, the mere assertion of apprehended bias is insufficient to iustify the transfer of investigation.
7. Having regard to the advanced stage of the proceedings before / the trial Court, and in view of the absence of any substantiated grounds warranting interference, this Court finds that the petitioner's p-qu_gst for transfer of investigation to the CB-CID is untenable and i I Ii 4 (-' - devoid ol'merit. Consequently, the prayer made in the writ petition is not maintainable
8. For the foregoing reasons, and in the absence of any tenable or convirrcing ground for interference, this Writ Petition stands dismisseo. There shall be no order as to costs. Misr>ellaneous Petitions, pending if any, shall stand closed /ffRUE COPY/ SD/. B. REKHA RANI ASSISTANT REGISTRAR G SECTION OFFICER To
