Toclay v,,hcn the matter has been taken up for hea;iing, learned Assistant Govcrnment Plcader for l{orne .ppearing for respontient Nos.1 to 4, placed on recorcl inslructiorrs issued by respondent No.4, wherein it \*ry4{{ \I\r ''-' - submitted that on 03.07.2025, respondent Nos.12, 13 and 14 lodged a complaint before respondent No.4 stating that on 03.07.2025, petitioners No.1 along witl-r 20 unknown persons trespassed their Plot No.12, 13 and 23 and damaged pre-cast compounrl walls. On such complaint, FIR No.468 of 2025 dated 03.07.2025 under Section 329(3),324(4\ read with 3(5) BNS was registered. It is further submifted that after completion of investigation in FIR I{o.r.58 of 2025 dated 03.07.2025, appropriate report will be filed before the concerned Court.

4. Learned Assistant Government Pleacler for Home further submits that except conducting investigation in FIR No.468 of 2025 dated 03.07.2025, the respondent authorities neither interfered with the petitioners' peaceful possession nor threatened the petitioners to evict the subject property. I

5. At this stage, learned counsel for the petitioners submits that the petitioners were not aware of registration of FIR No.468 of 2025 dated

03.07.2025, as the copy of the same was not served on the petitioners and further pray this Court to grant liberty to petitioners to seek appropriate remedy as availablc uncler law.

Recording the submissions made by learned counsel appearing on either side and without expressing any oPinion on the merits of the case, this writ petition is disposed of directing respondent authorities to follow due procedure as contemplated under law for furthei course of action. It is made clear that the respondent authorities shall serve a copy of FIR No.468 of 2025 f ,/ d'ated 03'07 '2025 to the petitioners and the petitioners shalr co-operate with the pending investigation in the aforesaid FIR.

7. With thc abor.e direction, this writ petition IS disposed of. Miscellaneous applications, if anv penciing, shall stand closed.
