Heard Sri S.Lakshmikanth, learned counsel for petitioner, Smt N.V.R.Rajya Lakshmi, learned Standing Counsel for Central Government representing Sri N.Bhujanga Rao, learned Deputy Solicitor General of India, for respondent No.l and Sri Sridhar Bhuvanagiri, learned Assistant Government Pleader for Home, for respondent Nos.3 ald 4. Perused the record.

3. Learned counsel for the petitioner submits that mere arraignment of the petitioner in a criminal case cannot be a ground for deniai of passport. He relies on the judgment of this Court in W.P.No.31316 of 2025, dated 27.1O.2O25. 4 . Learned Counsel for the respondents submits that the criminal cases uide C.C.No.1123 of 2021 and C.C.No.ll24 of 2024, on the file of the learned Principal Junior )ivil Judge Cum \ \BK.J \\P it6lg l0lj Additional Metropolitarr Magistrate Court at Jlajendranagar, is pending against the petitioner. It is submitted t'T rt the respondent authorities would consider the petitioner's appl< ation for a period of one year only, if he obtains permission to tra\1 I abroad from the court where the criminal cases are pending agairt t him.

Be that as it may, considering the judgmerr of the coordinate Bench of this Court in W.P.No.31316 of 2025, lated 27.1O.2O25 and the purpose for which the passport is beinl requested by the petitioner, this' Court directs the respondent I o.2 to issue the passport to the petitioner on the following condit r ns: i) The petitioner herein shall submit an ur dertaking along with atr affidavit in C.C.No.1123 of 2024, Pendir g on the file of learued Principal Junior Civil Judge Cum Additicr al MetroPolitan Magistrate Court at Rajendranagar., stating tlL: t he shall not leave India during pendency of the said C.C., wi:l out permission of the Court and that he shall cooPerate with trial Court in concluding the proceediugs ia the said C.C; ii) On filing such au undertaking as well 's allidavit, the trial Court shall issue a certified copy of the sarl : within two (2) weeks therefroml iii) The petitioaer herein shall submil an application afresh along with certified copy of this order as well as the aforesaid undertaking before the PassPort OfIr er / Authority concerned for issuing the PassPort; iv) On Frling such an application, the I'i ssPort Officer/ Authority shall consider the same afresh in 'l e light of the observations made by this Court herein as weU a; the contents of the undertaking given by the Petitioner for issu:.r g the PassPort' in accordance with law, within three (O3) weeks I om the date of said application; vl Respondent No.2 shall consider the 'assport Rules, 1967 while considering the apptication for issuing of the passport to the petitioner; \aK.l \\P lt6le lr)li vi) The co rpetent authority shall specify the permission period of one year for the petitioner to reneq, the passport for travelling abroad, and also obtain appropriate undertakiug froin the petitioner stating that the petitioner shall not overstay the permitted period and shall sutrender the passport upon return to India. vii) Any other condition as deemed appropriate by the trial Court.
