The case of the petitioner in brief, is that the petitioner was enrolled as Home Guard vide D.O.No.64106, dated 30.72.2O0G and while discharging his duties the petitioner was absent for a period ot three months due to his health condition. ,r. 2 SN. 7. The learned counsel appearing on behalf of the petitioner however submits that the said order of the Division Bench is followed by this Court in W.p. (TR) No.173 of 2017, dated 21.06.2077 and also the orders dated 08.06.2O18 passed in W.p. No.35640 of 2013 and batch, and order dated 17.08.2018 passed in W.P. No. 2942I of 2018 and therefore the petitioner herein is also entifled for the similar relief since the impugned order was passed without giving any opportunity to the petitioner therein in terms of the Rure 7 (4) of the Madras Home Guards and therefore, the impugned order is to be set aside and the respondents are to be directed to reinstate the petitioner into service without any benefits in relation to their past service including seniority, continuity of service and attendant benefits. The FIRs lodged in the year 2020 occasioned the petitioners to approach Courts seeki ng protection under Section 438 of the Cr.P.C. Two of th e petitioners have not secured such protection. Petitioner No. 1, it appears was not arrested. But even assuming for a moment, that the petitioners have come with some delay, we find reassurdnce from the opinion of this Court in the judgment reported in Assam anm ita 207 CC1 wherein this Court has inter alia held as follows: ha v. As per the observations of the Apex Court in the above said judgment, this Court opines that delay or laches by itself would not be sufficient to shut the doors of the Court on the petitioner herein and duly taking into consideration the submissions of the tearned counset appearing on beharf of the petitioner that the subject issue is squarery covered by the order dated Lg.Lz.zo2g passed in W.p. No. 26922 of 2023, which is not disputed by the learned Assistant Government pleader for Home, 10 SN, .I $ P 43150 1022 appearing on Court unde:r behalf of respondents, whereu nd'er this similar circumstances directe'C the thereunder to reinstate the p€)tlitioners respon d e nts thereunrler as Home Guards subject to their physical fitness with a clear observation that the p(rtitioners thereunder however are not entitled to any benefit of continuityc,fservice,seniorityandarrearsol'payby virtue of ther orders of this Court in W'P'No'3546Gt of 203 & batch.
