3. Heard Sri Sunil Anand, learned counsel i ppearing on behalf of the petitioner and Sri D. Arun Kut iar, learned a Additiona-l Public Prosecutor appearing on be ralf of the respondent - State. Learned counsel for tJ e petitioner submitted that the petitioner filed a case under Section 498-A IPC and also a DVC case at Godavarikhani, as she was residing there at the tirne of frting the cases. Now, the petitioner is residing with her brother at Hyderabad and is suffering from hea-lth ailments, for which she is regu larly undergoing treatment at Hyderabad. Her mother l is also aged about 60 years and therefore, she cannot travel from Hyderabad to Godavarikhali on each ald every occasion. He furtfrer submitted that the respondents are also residing at Boduppal, Hyderabad, and the notices were served to the same address. Hence, if the cases are transferred, no prejudice would be caused to the respondents and prayed the Court to transfer the cases from Godavarikhani to Hyderabad.

Having considered tfre submissions made by the learned counsel for the petitioner ald on perusal of tl.e material available on record, it appears that the petitioner is suffering from Iibroadenoma in the breast and 'is regularly undergoing treatment for the same. Further, it is noted that the respondents are also residing at Hyderabad. Therefore, this Court deems it I appropriate to transfer C.C. No.553 of 2021, on the frle of the learned Principal Junior Civil Judge, Godavarikhani, Peddapally District, to any competent Court at Hyderabad or Secunderabad, - .sa...- : - - Tr.Crr-P.Nos.1i t aad rz9 0f 2()2s and D.V.C.
