2. Tlre petrtioner herein is claiming that he is tht: ab;olute owner and possessor of a house bearing H.No. 19-4-27.+ll0t3ll. admeasurinq ltr'7 sq.yards in Sy.No.259ll near Mjr Alam Filter main road. H.No.l9-4-2i,l,tl),'3 1, Fr 2 Miralam Tank, Hyderabad along with ten other properties (total I I properties) are affected in the said road widening program to the extent of 67.47 sq.yards. 6th respondent had addressed a letter dated 14.06.2024 to 3d respondent with a requelt to send the land acquisition proposals under Sections 146 and r47 of HMC Act,
1955. Vide letter dated 09.11.2024,3.d respondent informed grh respondent that the subject house of the petitioner is falling under the nature of land 'Road-G, and further 3.d respondent has issued letter dated l4.ll.2oT4 with a request to grh respondent to take up acquisition of the petitioner,s property as per G.O.Ms.No.275, MA&IID (GHMC-II) Deparrmenr, d.ated, 27.10.2017. Thus, 8rh respondent informed the petitioner that since the road effected portion is 67.47 sq.yards in H.No.19_4_274llol3l1, Miralam Tank, Hyderabad is falling under ,Road-G,. As per survey report dated

In the present case, structure value for the structures effected in the road widening programme is Rs.l7.9l6l_ + l00yo solitarium i.e. Rs.35,832 l- (Rs.17,916/_ x 2). Therefore, respondent officials have already initiated the process for payment of the said amount. The petitioner hled the present writ petition with a mala fide intention for wrongful gain. Therefore, they sought to dismiss the writ perition.
6. As discussed supra, the petitioner is claiming right over the subject house consisting of 167 sq.yards under registered sale deed No.265 of 1993, dated 09.03.1993. Respondenr Nos.5 to g dispossessed them from the said propefty and demolished to the extent of 67.47 sq.yards. According to respondent Nos.5 to g, petitioner encroached public road. They have only demolished the encroached area. They have not demolished or dispossessed the petitioner from his subject house. 8. In view of the above discussion, this writ petition is disposed of. Respondent No.g is directed to measure the extent of the house of the petitioner i.e. H.No.l 9_4_274/l()/3/1, near Mir Alam Filter main road, Hyderabad as mentioned in the schedule of the registered sale deed No.265 of l993,dated 09.03.19 93. Liberty is granted to respondent Nos.3 and g to take the assistance of revenue authorities for measuring the said property. If the allegation made by the petitioner that the respondent Nos.4 to g dispossessed the petitioner fi.om the aforesaid subject house and demolished to the extent of 67 .47 sq.yards out of l67sq.yards, they shall pay compensation to the petitioner herein in accordance with the procedure laid down under law. If the contention of rcspondent Nos.4 to 8 that they have only demolished the encroached area and that the petitioner is entitled for only structure value , they shall pay the same in accorda ce with law G.O.Ms.No.275 MALID. However, they shall complete the said exercise within a period of four (4) weeks tlom the date of receipt of a copy of this order.
