Learned cou-nsel lor the petitioners sLibnl ls that petitioner No.1 has submitted a representation date(1 21.1O.2025 to respondent No.2 seeking to revoke and canccl the illegal Sale Deed Dccumcnt I'1o.901 1 I2OAS executed in re; rect of Assigned land in Sy.I.lo.621/3 oi Nandigama Viilage B, Mandai, Ranga Redd1, District r,vhich was assigned to Sri Lrns ammaiah under Assignment Proceedings No.S/ 13a5/75, dat:d 28.O2.1977 Subsequentl1.,, a registered sa]e deed rvas creatc ( anci it -*'as sold to respondent No.S against the assignment la 'r,s. Ile subrnits that responcier-rt No.5 is claiming the above sairl lar-rd in the land cf petitioner Nc.1 i.e., land admeasuring Ac. 1.18 gts 1n Sy.N.os.618 &. 619/1 situated at Nandigama \'liage & Mandal, Ralga Reddl- District. But so far the said r )presentation 1S pending conslderation before respondent No.2

He further states that the recitals ol the Sale Deed Cocument No.555 of 2024 dated 23.05.2024, a:; per the Dharani Forta-1 rvould show th t petitioner No.1 is the at,r olute owner and 4 possessor ol the land admeasuring Acs. ). 1700 gts 1n I -) S1,-.Nos.6l7/A, 618 lA situated at Nandigama Vrllage & Mandal, Rar-rga Reddy District. Further, the land rs not an assigned land as defined under Telangala Assigned Lands (Prohibition of Trar-rsfers) Act 9 ol 1977 and the schedule lar-rd is n:rt attracted b1, the prov;sions of Telangana Land Reforms (Ceiling on Agricultural Hoiding) Act No. 1 of I973. He further contends that respondent No. 5 is il1ega1ly claiming the land belonging to petitioner No. I only to harass him and seeks to pass appropriate orders.

Learned Assistant Government Pleader for Revenue bv furnishing the copy of lvritten instructions submits that the land admeasuring Ac.l.27 gts in Sy.No.621l3, situated at Nandigama Village and Mandal was acquired by respondent No. 5 through registered Sale Deed document bearing No.9O 1 1 of 2005 dated
14.09.2005 from the original assignee Sri Lingamaiah who obtained the land vide Assignment Proceedings RC No.B5/a034l1977 dated 19.O9.1977. The officia.l respondents conducted enquiry and on verification of revenue records found that in contravention of the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 it was found that the land admeasuring Acs.lL.27 g\s in Sy.No.62 1 situated 4 at Nandigama Village and Maldal was z ssigned b,y the Gover nrnent to land less poor person. He fltrther contends that respondent Nr.5 has erected a precast compound u,al[ around the said l-r-rd, rl'hich was demolished by the authorities by issuing notices to the concerned parties and that action would be ini iated as per A.P. Assigned Lards (Prohibition of Transfers) Act. 977. Further, he states that the matter is under consideratr( n before offrcial respondents and therefore, seeks to dismiss thr: Writ Petition.

LearneC counsel for respondent No.:j contends that unofficial respondent No.5, being the lanrl iess poor has purchased the subject property vide regir; ered sale deed document bearing No.9O11 of 2OO5 dated 14.0,) 2O05. Therefore, he submits that after a lapse of about (l9t long ]'ears, the petitioners filed the present Writ Petition, witho, Lt any basis only to harass respondent No.5. He further takes e n objection with regard to the maintaina-bility of the present Wr-i . Petition stating that the petitioners does not have any locus r tan-di to file the Dresenr Writ Petition. Stating thus, he seeks to dismiss the Writ ) Petition 7 . Havu-rg regard to the submissions of al1 the learned coun sel, on penrsal of the r'r,ritten instructions issued by respondent No.4, wherein it is averred that the precast compound wall erected by unolficial respondent No. 5 was dcmolished by ofhcial respondents and on keeping in vieu' the representation dated 21.1O.2025 submitted by the petitioners, this Court, '"r,ithout making any observations on the merits ot demerits ol the case, deems it appropriate to direct tl-re oificial responcients to strictly follcw the d-ue procedure as contemplated under lau,, before taking any aclion on the subject property
