4. Admittedly, the petitioners herein are defendants Nos.l,3, 6 to 8 in the said suit. During the course ofhearing, it is brought to the notice of this Court that the respondent Nos.l to 5 /plaintiffls in the said suit did not file any application restraining the def'endants including the petitioners herein from alienating, encumbering and changing the physical leatures of the suit schedule propertr in any manner ln the absence of the same, the petitioners herein cannot contend that other defendants are trying to dispose olthe suit schcdule propefty during the pendency of the said suit. They can contend that any alienation during the pendency of the suit is hit bi, doctrine of /rs pendens in terms of Section 52 ol the 'l'ranslbr ol Property Act, 1882 (for short, 'the TP Act') Instead of doing so, they havc filed the present revision seeking a direction to the trial Court to dispose of the said suit as expeditiously as possible.
5. Therefore, the petitioners are not entitled tbr any reliel-, this revision fails. It is liable to be dismissed and accordingly dismissed Consequently, pending miscellaneous petitions, if any, in this revision shall stand closed.
