Thc Writ Appeal arises out of an order d,att.< 12.09.2025 passed lty the lcarned Single Judge of tL i , Court in I Z MB,] & GP(,] s/a 1211 2025 W.P.No.1OO72 of 2OO7 by allowing the sard Writ petition and giving liber[ to all the parties to approach thc comperent Civil Cou rt for cstablishine Lheir rcspectivc claLms of succt_.ssion to the properlics of the deceased father of one of the claimants to thc suit schedule property. The iearncd Single .Iuclge also drrectcd the revenue authorities to act upon thc mutatiou proceedings only after a final decrce being passed by the competenL Civil Court.

Although wc do not fincl any' grier':rnce u'hich can be raisecl by thc writ petitioncrs in the present Appeal, sir.rce the Writ Petilion was allowed giving liberty to the appellants to approach appropriate Civil Court, Senior Counsel submits that therc arc certain observations in the impugncd order inctuding in paragraphs 17 & 18 thereof, which may have a bearing in the Suit lilcd by the petitioners or in any Suit which the pctitioners mav file in the future.
4.
