VIIAYSEN REDDY WRIT PETITION No.31975 OF 2025 ORDER: (ORAL) This writ petition is filed by the petitioners seeking to declare the action of respondents No.2 to 5 in interfering with their possession and enjoyment in respect of the land admeasuring 150 square yards in Survey No.41l3, situated at Khanamet Village, Serilingampally Mandal, Ranga Reddy District, without following due process of law, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. S.Sridhar, leamed counsel for the petitioner; Mr. G.Madhusudan Reddy, learned Standing Counsel for GHMC, appearing for respondents No.2 and 3; and perused the material on record

The petitioner claims to be the owner and possessor of the land admeasuring 150 square yards in Survey No.41l3, situated at Khanamet Village, Serilingampally Mandal, Ranga Reddy District having purchased the same from its previous owner under Registered sale deed dated 14.07.2025. The vendors of the petitioners are the legal heirs of the original owner by name Mr. Syed Abdul Majeed S/o Syed Abdul Waheed who purchased the same under registered sale deed bearing ., : 2 documenl No.18487 of 2013 dated 21.12.2013. It is submitted when the petitioners intended to purchase the property, the sale deed was not registered by the registering authority stating that the subject property is Governmt:nt land as per letter No.EL/448312024 dated 21.01.2025. Aggrieverl by the same, the petitioner filed w.P. No.10984 of 2025 before thi:; Court and the order dated 26.06.2025 was passed directing the registerinl5 authority to receive, register and release the said document. Pursuant thereto, the sale deed of the petitioner was registered vide document No.9879 of 2025 dated 14.07.202.5. It is submitted that recently, in September 2025, when there were heavy rains in Khanamet area, the rain water entered into the rooms in the subject property which are constnrcted by the vendors of the petitioners. The petitioners decided to demolish the rooms and started construction of rooms by raising the basement and informed respondents No.2 and 3 orally. while So, on 14.10.2025, respondents No.2 to 5 without issuing any notice have highhande,lly enteied into the subject property and partly demoliJ[ed the structures raised by the petitioners in the subject property. Learned counsel for the petitioner submitted that the action of the respondent authorities in interfering with the possession of the petitioners is illegal arbitrary and the same is violation of principles of naturaljustice. 3

4. Learned Standing Counsel for GHMC submitted that action if any taken against the petitioners in respect of the unauthorized construction, if any, made by them will be by lollowing due process of law

Recording the atbresaid submission, this writ petition is disposed of directing the respondent authorities not to interfere with the possession and enjoyment of the petitioners in respect of the structures raised by them subject property admeasuring 150 square yards in Survey No.4ll3, situated at Khanamet Village, Serilingampally Mandal, Ranga Reddy District, without following due process of law. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any, pending in SD/. A.SRINIVASA REDDY ASSISTANT REGISTRAR this writ petition, stand closed. \ Note : That the l.A.No.2 of 2O2S fited for correction of Order, dated 14-11-2025 in W.P.No.31976 of 2025 in the 4th lihe of para No.3 and in 9th line of Page No.2. The same is corrected and amended forthwith, as per the Court Order, dated 08-12-2025 in l.A.No.2 of 2025.
