Counsel for the petitioner: SRI RAGAM VISHAL Counsel for the Respondent No.1 to 5: SRI L.RAVINDER, L( ip FOR REVENUE The Court made the following: ORDER THE HON'BLE SRI JUSTICE E.V.VENUGOPAL WRIT PBTITION No.3 19o6 of 20125 ORDER: This Writ Petition is filed seeking a writ of mandamus declaring the action of the respondents 2 to S in not considering the representation of the petitioner dated I3.1O.2O25, requesting to stop mutation of the names of respondent Nos.6 and 7 witln regard to the petitioner,s land to an extent of Acs.4.OO guntas in Sy.No.B6 /Al2/3, situated at Degama Village, Bazarhatnoor Mandal, Adilabad District (hereinafter referred to as the ..subject property"), as illegal, arbitrary and in violation of Article 300-A of the Constitution of India, and conseguently, to direct the respondent No.2 not to entertain any alienation or registration with regard to the subject property till the disposal of the writ petition.

Learned counsel for the petitioner subrr its that the petitioner is the absolute owner ald posse isor of the subject lald, having inherited the same from }L's ancestors The name of the petitioner has been entered irr the revenue records, ald a digital Pattadar Passbook rearing No T13030160122, vide Khata No.317, was also i ,sued in his favour. Since then, the petitioner has been in peaceful possession and enjoyment of the same. 4 . While things stood thus, learned co ur sel for the petitioner submits that respondent Nos.6 anrl 7, who are strangers to the property, made an applicatir,r L before the 5th respondent on 07.08.2O25 for mutation o1 .heir names in the revenue records on the basis of a str la bainama purportedly executed by the petitioner. He subr petitioner has no relationship with . responder rits that the I ts6andT and has never executed the said sada bainam-; He further submits that, based on fabricated documents. espondents 6 and 7 are attempting to incorporate their rL Lmes in the revenue records. Aggrieved by such action, ti e petitioner mhde a representation before the 2"d res,1 ondent on I L J
13.1O.2025. He further submits that the petitioner has a_lso filed a suit for perpetual injunction before the Special Deputy Collector, ITDA, p.O. Utnoor, Adilabad District, against respondents 6 and T, in which they have already entered their uakala| and the said suit is pending consideration. The petitioner contends that there is every likelihood of respondents 6 and 7 succeeding in incorporating their names in the revenue records based on the fabricated sada bainama. Despite receipt and acknow,ledgment of his representation dated 13.10.2025 by the 2nd respondent, no action has been taken till date. Hence, the petitioner seeks appropriate directions from this Court.

On the other hald, the learned Assistant Government Pleader for Revenue, upon instructions, submits that the petitioner has not furnished details regarding the pending suit before the Special Deputy Collector, which he claims to have fiied against the unofhcia-l respondents. He further submits that before taking arry action, the official respondents will follow the due process of law.
