Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or orders more particularly in the nature of Writ of Habeas Corpus by directing immediate production and release of Ms. Yadla Bhaashyavi, aged 20 years, from any illegal custody or confinement, trace her present whereabouts forthwith and ensure that her statement is recorded before a Judicial Magistrate in a free and safe environment, take departmental action against the police officials responsible for illegally detaining and transferring her against her will, ensure protection to Ms. Bhaashyavi and Syed Zafar lives and liberty, so that they may solemnize their intended marriage peacefully without threat or interference from any quarter and to take immediate steps to trace [vls. Yadla Bhaashyavi and to restore her liberty in the interest of justice and protection of fundamental rights. 23.10.2025, this Taken Up Writ Petition was registered based on the letter submitted by Mr.Syed Zafar complaining about the illegal cont-rnement and violation of liberty of Ms.Yadla Bhaashyavi, aged 20 years.
2. On 24.10.2025, since the Court was informed that the alleged detenue, who is an adult, was lodged at Shakti Sadan as per her own wish, this Court disposed of the Taken Up Writ Petitron 2
3. Subsequently, I.A. (SR) Nos.107776 and 1l25ri r of 2023 were filed by the petitioner on 14.1 1.2025 and 27.11.202: respectively to restore the Taken Up Writ Petition No.3 of 2025 and .r grant leave to the petitioner to contest the Taken Up Writ petit,r n through his counsel.
4. Though offrce raised certain objections as to the naintainability of the applications, the same were over ruled and a;1 lications were allowed vide docket order dated 17 .12.2025 and the rrz :ter is restored to file. Therefore, the Taken Up Writ petition is taken rr: , for hearing. 5 Heard Sri Shaik Sail-ultah, leamed counsel apc:aring for the petitioner and Sri Swaroop Oorilla, learned Speci I Govemment Pleader representing the leamed Advocate General ap1 earing for the respondents.
6. Learned counsel appearing for the petitioner sulr n itted that the petitioner is the lover of the afleged detenue and I at they were plannirrg to get married.
7. On the other hand, learned Special Govenr nent Pleader representing the leamed Advocate General appe I ing for the respondents subrnitted that the alleged detenue is curr,: rl.ly lodged at 3 Shakti Sadan, Hyder ShaKote, Gandipet Mandal' Ranga Reddy District.
8. Considering the facts presented to the Court' this Court directed respondent No.4/the Station House Officer' Petbasheerabad Police Station. Medchal-Malkajgiri District to produce the alteged detenue in Court on l}.l2-2025. g. On 10.12-2025, we have interacted with the detenue in the chamber. we have also informed the leamed Special Government Pleader and the learned Assistant Govemment Pleader about our intention to interact with the parties and directed the matter to be listed on 11.12.2025, tbr personal presence of the petitioner and mother of the alleged detenue before this Court' t0. On 11.12.2025, the petitioner, alleged detenue and the alleged detenue,s mother are present in Court. one of us (Justice Gadi Praveen Kumar) has asked several questions to all the three parties in the language to their choice (Telugu) and they answered the questions in the presence of leamed counsel appearing for the petitioner and the leamed Special Government Pleader appearing for the respondents' 4 I 1. This Court. while Reserving the matter for orders' Cirected that the alleged detenue shall remain in the place where s -re has been lodged for the last two months i'e. at Shakti Sadan rutr by Kasturba Gandhi National Memorial Trust, Hyder Shah K'r e, Gandiper Mandat, Ranga Reddy District, til[ pronouncement of or' j :t's' 12- On 10.12.2025, in our interaction with the allegei detenue, she stated that her parents had separated long back and her nother is not consenting for her marriage with the petitioner' Hower t r, the alleged detenue expressed her willingness to marry the petition': and lead life with him.
13. Sri Swaroop Oorilla, learned Special Govenr nent Pleader appearing on behalf of official respondents in the pr:sence of the petitioner, alteged detenu and the mother of alleged de'r nu contended that the petitioner is having criminal history earlier as he was involved in a similar incident.

The mother of the alleged derenue stated that the tntecedents of the petitioner are questionable as he is having criminal r story and that he is also holding fake employment certihcate, therel; ' she suspects 5 that her daughter w'ould not be safe hands in the event of marrying the petitioner. I 5. We once again interacted with the alleged detenue in open Court, who in tum asserted to live with the petitioner and that she is willing to marry the Petitioner.
16. The petitioner denied the allegations made against him by the leamed Special Government Pleader, however, assured to look after the alleged detenue well in every manner.
17. Since the alleged detenue is produced before this Court and since she is a major, this Court deems it fit to allow the detenue to proceed as per her will and wish.
18. Having regard to the cumulative circumstances placed on record, including the young age of the petitioner, the criminal antecedents and pending prosecution of the petitioner and his implication in the connected case as well as the absence of any independent means of livelihood on his part and the apprehensions expressed by the mother of the alleged detenue, it is needless to say that in the event of any untoward incident which may take place in 6 \---- future, the alleged detenue is at liberty to take appropr ate recourse available in law.
19. The officiat respondents are directed to releast the alleged detenue from Shakti Sadan run by Kasturba Garr, hi National Memorial Trust, Hyder Shah Kote, Gandipet Mandal' J 'anga Reddy District, from where she is presently staying
20. ln view of the aforesaid circumstances, sinc: the alleged detenue is produced before this Court, we are not inclir:d to go into the merits of the case. 2t.
