Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate Writ or order or direction more particularly writ one in the nature of Writ of Mandamus declaring the action of Respondent No. 1 in not allowing the petitioner to appear for written test/interview for selection and appointment to the post of Office Assistant as illegal, arbitrary and contrary to the judgment of the Hon'ble Supreme Court of India reported in 1996(6) Scale 676 and consequently to direct the respondents to consider the case of the petitioner for selection and appointment to the post of Office Assistant without insisting that the name of the petitioner should be sponsored by the Employment Exchange; The petition coming on for hearing, upon perusing the Petition and the affidavit herein and upon hearing the arguments of SRI B.P.RAJU Advocate for the Petitioner and of Govt. Pleader for Employment and Training for respondent No.2, the Court made the following:

ORDER:

Post ‘ for admission’ after three (3) weeks. In the meanwhile, the respondents shall consider the case of the petitioner for the post of Office Assistant, if he is otherwise insisting on sponsoring by the Employment eligible, without Exchange.
