Aggrieved by the inaction of the respondent No.2 in receiving, registering and releasing of the sale deed presented by the petitioner in respect of a residential house bearing H.No.28 -97 I A, PTI No. 1280768786, 1n Sy.No. 152, to an extent of 105 Sq.Yards out of 205.22 Sq.Yards, on western side with a built up area of 945 P Sq.Feet of RCC roof, situated at Neredmet, Malkajgiri, within the limits of GHMC, under Malkajgiri Circle and Mandal, Medchal-Malkajgiri District, the petitioner filed ,l the present writ petition. \\

Learned Assistant Government Pleader for Stamps and Registration submits that without presenting the 2 SK, J u,, P _.3 I 799 _2025 document, the petitioner has approached this court seeking registration of the document. If the petitioner presents the sarne before the Registering eruthority, the respondents will receive the same and follow the procedure as contemplated under section 7 t of the Registration Act, 1908 (for short, the Act, lgog).

The Section 7l of the Act reads as follows Reasons for refusal to register to be recorded.- (1) Every Sub-Registrar refusing to register a document, except on the ground that the property tr> which it relates is not situated within his sub-district shaLl make an order of refusal and recorded his reasons for such order ir-r his Book No.2, and endorse the worcls "registrertion refused" on the document; and, on applitation made by any person executing or clai'ming under the document, shall, without payment and unnecessary clelay, give him a copy of the reasons so recorded. (2) No registering officer shall accept fcrr registration a document so endorsed unless and unt-il, under the provisions hereinafter contained, the document is directed to be registered. / - // ;' ,( -7/ 3 S1(. In view of the above made submissions coupled with the provision under Section 7L of the Act, 1908, this writ petition is disposed of directing the Registering Authority to receive, register and release the subject document, subject to the petitioner complying with the provisions of the Act, 1908 as well as the lndian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registeredr

6. Miscellarreous Petitions, if any, pending in this writ petition shall stand closed.
