The Court made the following: COMMON ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA l.A.Nos.3 and 4 of 2025 in/and CRIMINAL PETITION No.'13618 ot 2025 COMMON ORDER: This Criminal Petition is filed by the petitioners/accused Nos.2 and 4 under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('for short 'BNSS') seeking to quash the proceedings against them in S.C.No.73 of 2021 on the file of the Special Judge for Trial of Cases under SC/STs (POA) Act, 1989 -cum- Vll Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, registered for the alleged offence punishable under Sections 323 and 504 of the lndian Penal Code, 1860 and Section 3(t)(r)(s) of SCs/STs (POA) Amendment Act, 2015.

2. lt is submitted by learned counsel appearing for the petitioners/accused Nos.2 and 4 as well as respondent No.2 that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos.3 and 4 of 2025 have been filed to record compromise between them and to compound the offences.

3. The learned Additional Public Prosecutor has opposed the said compromise petitions -l 2 Crlp_11618 2025

4. Perused the affidavits filed by lhe de facto l.A.Nos.3 and 4 of 2025 which disclose that I complainant in : has willingly consented for compromise. Since the parties werr, willing to enter into compromise, they were given a chance to setr I r the matter by appearing along r.vith their respective counsel befor,: the High Court Legal Services Committee for the State of Telangi na vlde orders daled 23.10.2025 passed by this Court. The Secre I 1ry, High Court Legal Services Committee shall identify the partier and submit a report to that effect.

Pursuant to the above said direction issued by this Court, the parties along with their respective counsel have app,: rred before the High Court Legal Services Committee for the State oi f elangana and the Secretary of the above said Authority identified re parties and submitted a report dated 31 .10.2025 stating that tr ) parties were identified and they have willfully and without any cc :rcion entered into compromise as per the terms of compromise.

6. ln view of the above, l.A.Nos.3 and 4 of 20,2 i are allowed. Consequently. the Criminal Petition is allowed and tt e proceedings in S C.No.73 cI 2021 on the file of the Special Ju: Cases under SC/STs (POA) Act, 19Bg -cum- Vll A<l gnd Sessions Judge, Ranga Reddy District at L.B.N;l ;e for Trial of Iitional District yar, registered ./ 3 L'TD. J \J 22 disputes amicably so as to avoid unpleasant feeling among them since they are residing the same locality of the village to as to maintain harmony in the village since the dispute occurred during heated argument while buying cigarette at Kirana shop run by the Petitioners. Both the parties realized and thought to put quietus to the issues and tl-rey cornpromised their disputes and the complainant agreed to withdraw the criminal case filed against the Petitioners. In view of th(l compromise of the matter between the parties, the 2nd respondetrt is not interested to continue and prosecute the criminal proceedings against the petitioners/Accused and he has no objection to quash the proceedings against the Petitioners. Therefore the continuation of proceedings agait-lst the Petitioners is nothing abusing the process of the court. It is submitted that 2nd respondent entered into compromise with the Petitioners/Accused on his own volition and Will and consent. o coerce, force, anv undue influence and collusion. In e settlement and cornpromise, no purpose would be served if the proceedings are continued against the petitioners and therefore the proceedings against the Accused are liable to be quashed.
