Madal Mohan Rao, learned Senior Counsel representing Sri M. Srinivas, learned counsel for the appellants and Sri G. Prabhakar, learned counsel for the respondent-Bank.

2. The present Writ Petition is {iled seeking to direct the Debts Recovery Tribunai-I, Hyderabad (for short, 'the Tribunal') to dispose of M.A.No.27 of 2025 in O.A.No.166 of 2019 read with R.C.No.l22 of 2022, as ea-rly as possible in accordance u,ith law, as per the time stipulated by this Court.

The petitioners have filed an application under uide M.A.No.27 of 2025 before the learned Debts Recoverv Tribunal I, Hyderabad, under Sections 19 (20A) and Section 26Q) e (3) of Recovery of Debts and Bankruptcy Act read with Section 151 of the Code of Civil Procedure, seeking recall of the Recovery Certificate in RC.No. 122 of 2022 in O.A.No.1.66 of 2019, dated 02.07.2022. The said .- 2 application was filed only on 21.O5.2O25. According to the learned Senior Counsel, Debts Recovery Tribunal-l is not disposing o[ the said application in accordance with law. However, he has fairly submitted that the said application has been posted to on 29.10.2025 by the Tribltnal. In the meanwhile, during the pendency of the said application, respondent No. 1 is proceeding with initiation of proceedings ur.rder SARFAESI.

4. Referring to the docket proceedings of the Tribunal, learned counsel for the respondent-Balk would submit that the sairl M.A. is posted to today i.e., 17.10.i2025 and it is adjourned to 29.1O.2025. The Tribunal will have to verify the record and pass appropriate orders.

In the light of the above submissions, the Writ Petition is disposed of directing respondent No.2 to dispose of M.A.No.2'7 of 2025 filed by the petitioners, strictly in accordance r.l ith law, AS expeditiously AS possible. However, liberty IS granted to the petitioners and respondent No.1 to raise all contentions before respondent No.2 in the aforesaid M.A., and it is for respondent No.2 to consider the same and pass orders in accordance with law. 3 6 Accordingly, the Writ petition is disposed of.
