Bhasker Reddy, learned counsel appearing on behalf of the petitioner, learned Assistant Government Pleader for Higher Education, appearing on behalf of respondent No.1, and Sri Malipeddi Srinivas Reddy, learned Standing Counsel for Osmania University appearing on behalf of respondent Nos.2 to 5.

2. praver as under: "...to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declare the actions of Respondents in not selecting the petitioner herein for the course of' Ph.D under Category-Il in Department of Physics under EWS Category inspite of having al! requisite qualifications and eligibility pursuant to the notification dated LL.OL.2O25 issued by Respondent No.3 as illegal, arbitrary, violation of articles L4, LO and 21 of the constitution of India besides being contrary to the rules, regulations and the prescribed procedure and consequentially direct the Respondents to select the petitioner for the course of Ph.D under Category-Il in Department of Physics under EWS Category in the vacancy notified vide notification dated 11.01.2025 in the interest of justice and to pass any such other order..." 2 SN, J wP_31705 2025

3. '[he case of the petitioner, in brief, is that the petitioner is qualified and eligible for the admission into the course of ph.D under category-Il. The respondent No.2 university released a notification dated 11.01.2025 for the admission into the said Ph.D c()urse. The petitioner had applied for the same through the znd respondent University online portar vide Application Registration No.200047503 on 23.02 .202s and thereafter the 3.d respondent conducted the computer based test on 09.06.2025 and the petitioner got qualified in the said test and was called for intervievv on 05.07.202s. Accordingly, the petitioner attended the interview and submitted all the required documents as mandated along with EWS/Income certificate for the year 2ozs-

It is further the case of the petitioner that pursuant to the interview, the final result had been announced on 29.og.zo25, in which the petitioner's name had been missed, and two vacancies in the quota of EWS had not been fiiled Up, stating that no eligible c.rndidates were found under EWS category. Aggrieved by the same, the petitioner gave representation dated

30.09.2025 to the respondents 3 and 4 but till now no action had (r n 3 SN, J wP 31705 2025 been initiated. Hence the petitioner approached this Court by way of the present writ Petition.

PERUSED THE RECORD Fi (a) In pursuance to the Ph.D admission notification issued by the Respondent University dated 11.01.2025, the petitioner applied for admission and petitioner had been qualified in the Ph.D Entrance Test on merit and the petitioner even attended the Ph.D. interview in physics held on 05.07.2025. (b) As per the note provided in the interview list released by. the respondent university, the petitioner submitted petitioner's EWS (Economically Weaker Section) Certificate for the year 2025-26. (c) The petitioner fulfilled the eligibility criteria laid down as per the rules as prescribed in the Notification dated

11.01.2025. (d) Despite meeting the criteria, the petitioner was not allotted a seat under EWS Quota even though 2 EWS quota seats in Physics remained unfilled. J/ 4 SN, J wP 31705 2025 (e) The petitioner submitted a representation dated 30.09.2025 requesting the 2nd respondent herein to reconsider the sl,bject issue pertaining to providing admission in ph.D. Course in the respondent university under the EWS euota duly taking into consideration the remarks written by the Interview panel on petitioner! EWS Certificate and reconsider the candidature of the petitioner for one of the vacant EWS seats in the Physics Department.

Learned standing counsel appearing on behalf of the Respondent Unaversity submits that the 2rd respondent may be directed to consider the grievance of the petitioner as put forth by the petitioner vide petitioner,s representation dated 3O.O9.2O2S addressed to the 2nd respondent herein, in accordance to taw, within a reasonable period 7 case, (a) The aforesaid facts and circumstances of the I t 5 SN, J wP_31705 2025 n (b) The submissions made by the learned counsel appearing on behalf of the petitioner and the learned standing counsel appearing on behalf of the respondents, (c) The contents of the representation of the petitioner dated 3O.O9.2025 addressed to the znd respondent herein), (d) The fact that the representation of the petitioner dated 3O.O9.2025 addressed to the 2nd respondent had not been considered as on date, (e) The discussion and conclusion as arrived at para Nos.S to 6 of the Present order, The Writ Petition is disposed of directing the znd respondent to consider the request of the petitioner for providing Admission to the Ph.D. Course in the Department of the Physics against one of the 2 vacant EWS seats in the Physics Department, duly taking into consideration the EWS certificate furnished by the petitioner dated OL.O7.2O25 and duly considering the remarks written by the interview panel in petitioner's EWS Certificate and pass appropriate orders peftaining to the request of the petitioner for selection to the Ph.D Course under Category-Il in Department of Physics under --, t 6 SN, J wP_31705 2025 the Ews category against the vacancy notified vide notification dated 11.o1.2o2st within a period of one (o1) week from the date of receipt of a copy of this order, in accordance to law and duly communicate the decision on the subject issue to the petitioner herein.
