With their consent, this writ petition is being taken up for disposal.

2. This writ petition has been filed questioning the action of respondent No.4 in interfering in the Civil Disputes and harassing/summoning the petitioner to the Police Station in the name of enquiry on the complaint lodged by the un-official respondent Nos.5 to 16 in respect of all that the Open Plot Nos.479, 480, 487, 488, 495, 496, 503, 504,510, 51L, 429, 430, 434, 435, 440,

441., 447, 448, 455, 463, 471,, 472, 41.4, 424, 415 and 425 total admeasuring 6715 square yards in Sy.No.563 situated at Ghatkesar Municipalitv and Mandal, Medchal Malkajgiri District as being arbitrary, illegal and withc>ut jurisdiction and seeking a consequential direction to respondent No.4 not to interfere in the civil disputes.

Le'arnecl Assistant Government Pleader appearing for Home has placed the written instructions submitted by Sub-Inspector of Police, Pocharam Police Station, Rachakonda Commissionerate wherein it is submitted that one Ch. Ramesh Reddy lodgect a complaint with the 4h respondent on 13.10.2025, wherein it is stated that the petitioner trespassed into the complainant's land and damaged the boundary wali rvith the help of \ \ I I 2 JCB vehicles and taken away the CCTV cameras, gate from the land. Pursuant to the said complaint, a case has been registered in Crime No.472 of 2025 dated13.10.2025 under Sections 329 (3),324 (4),303 (2) read with 3 (5) of BNS against the petitioner and others and investigation has been taken up. During the course of investigatiory notices under Section 35 (3) of BNSS are issued to A-1 and A-2 on17|1,0.2025 under proper acknowledgement. After finalization of investigation, an appropriate report would be filed before the competent court. It is further submitted that petitioner is arrayed as A-1. Along with the written instructions, a copy of F.I.R No.472 of 2025 dated

13.1.0.2025 has been annexed and the same has been furnished to the learned counsel for the petitioner across the bench.

In that view of the matter, since the F.I.R has already been registered, this writ petition is disposed of directing the respondent authorities to strictly follow due procedure as contemplated under law before initiating any further course of action on the petitioner. It is left open to the petitioner to seek appropriate remedy before the concerned trial Court.
