Soma Srinath, learned counsel appearing for the appellants and learned Government Pleader for Social Welfare appearing for respondent No.1 and Government Pleader for Revenue appearing for respondent Nos.2 to 12 and Sri J. Prabhakar, learned Senior Counsel representing Sri A.Srinivas, learned counsel appearing for respondent Nos.13 to 15.

The appellants herein had filed a Writ Petition uide W.P.No.3O7l6 of 2O25 to declare that the action of the respondents therein, more particularly respondent No. 13, in conducting the Diocesan Council Triennium Elections for the years 2025-2028 on 13tt and 14th October,2025,by excluding names of eligible members of the Churches of respondent No.13 Diocese from the final voters'list, despite the representations of the petitioner and the other aggrieved members, as illega-l.

The said Writ Petition came up for hearing before the learned Single Judge on 09.10.2025, on which date the 2 learned Single Judge ordered notice and also permitted personal notice to respondent Nos.13 to 15, directed the matter to be listed on 24.IO.2O25 upon filing proof of service. Feeling aggrieved by the said order, appellants preferred the present Writ Appeal under Clause 15 of Letters Patent Act.

As discussed supra, uide impugned order, dated O9.1O.2O25, learned Single Judge ordered notice and permitted learned counsel for the petitioners to take out personal notice and file proof of service by 24.10.2025. Thus the rights of the parties are not affected to maintain the present intra Court Appeal. The order impugned is not a judgment in terms or Clause 15 of Letters Patent. The principle was also laid down in Midnapore Peoples, Coop, Bqnk Ltd, a. Chunilql Nqndq.r.
5. Even according to the appellants, elections were already conducted on 13th and 14th of October, 2025, itself.
6. If appellants succeed in the said Writ Petition, their rights would be decided therein. Though they have preferred the present appeal being dissatisfied with the ' (zooo) 5 scc 399 3 order dated 09.10.2025, it is evident that the rights of the parties have not been affected by the said order.
7. In the light of the said discussion, the contention of learned counsel for the appellants that the preSent Writ Appeal is maintainable is not sustainable. Therefore, the Writ Appeal is liable to be dismissed
8. The presently appeal is accordingly dismissed. However, liberty is granted. to the''appellants to pursue the said Writ Petition. There shall be no order as to costs.
