VIIAYSEN REDDY WRIT PETITION No.31673 ot20?5 ORDER: (oRAL) This writ petition is hled by the petitioners seeking to declare the action of respondents No.2 to 4 in not acting upon their complaints datFd 04.10.2025 requesting not to construct any room or structure in the property bearing premises No.3-4-5 l6 to 518, situated at Barkathpura, Hyderabad, as being illegat, arbitrary and unconstihrtional.

2. Heard Mr. B.Rameshwar, leamed counsel for the petitioners; Mr. G.Madhusudan Reddy, leamed Standing Counsel for GHMC, appearing for respondents No.2 to 4; and perused the material on record.

3. The petitioners claim to be the owners of the premises bearing H.No.3-4-516 to 518, situated at Barkthpura, Hyderabad. The petitioners submitted representation dated 18.04.2008 stating that the subject premises was used by the respondent authorities and public toilet was constructed about thirty (30) years back. On complaint lodged by the petitioner, action was initiated and the public toilet was 2 demolished on 30.11.2024. The petitioners had been equesting the respondent authorities to remove the debris of the demol ;hed toilets as it was creating nuisance and health hazards. Pur uant thereto, the debris was removed in the month of Sep :mber 2025. The petitioners came to know that tenders were called .i r construction of reading room/library in the subject premises wher: debris of the demolished public toilet was removed earlier. It is subrr tted that there is a lane abutting to the subject premises which is l3 fe,: width. Ilany room or structure is constructed in the subject premisr:r , the width of the road gets reduced to 5 feet thereby causes severe tardship to the local residents including the petitioners. In that regard; ,he petitioners submiued representation/complaint dated 04.10.2025. rut so far, no action has been initiated. As such, the petitioners ar(, lonstrained to approach this Court.

Leamed Standing Counsel for GHMC submitted t Lat appropriate action will be taken on the representation/complaint ol the petitioners in accordance with law. 5 Recording the aforesaid submission, without er ering into the merits of the case, this writ petition ls disposec of directing 3 respondents No.2 to 4 to consider the representation/complaint of the petitioners dated 04.10.2025 requesting not to construct any reading room or library in the property bearing premises No.3-4-5 16 to 518, situated at Barkathpura, Hyderabad, and to ensure the safety of the local residents, by giving opportunity of hearing to the petitioners and other concemed/interested persons, and pass orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
