THE HON'BLI SRI JUSTICE E.V.VENUGOPAL WRIT PEf,ITION No.31579 of 2o.25, ORDER: This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents 2 & 4 in not issuing pattadar passbook and title deed in respect of lands to an exterit of Ac.1.10 guntas in Sy.No.851/C/A and Ac.1.10 guntas in Sy.No.851/C /B, totalTy adrneasuring Acs.2.20 guntas, situated at Chigurumamidi Village and Manda-I, Karimnagar District(hereinafter wiII be referred to as 'subject property) in pursuarce of application No.l7O10O60-392, dated LO.O6.2O25 as illegal, arbitrar5r and in violation of Articles L4,21 and 3OO-A of the Constitution of India and consequently to direct the respondents 2 & 4 to issue pattadar passbook and title deed to the petitioner in respect of the subject property. .l- 2
2. Heard learned counsel for the pet tioner and Sri L.Ravinder, learned Assistant Governr:::nt Pleader for Revenue.
3. L,earned counsel for the petitioner sr.bmits that tJle petitioner is absolute owner and posst ssor of the subject property, having purchased the stt ne through his father. His name was recorded in reve'r Lue records and he was also granted pattdar passbo( k and title deed vide patta No.947 in his favour in r<:: pect of the subject propergr. However, when some tl ird parties namely Ponnam Kanakaiah and Ponnam Rr ja Mallaiah were interfering with the peaceful posr;:ssion and enjoyment of the petitioner over the subjr: :t property, the petitioner hled suit in O.S.No.249 of 2( 14 and tJ,e sarne was decreed on 18. 10.2019 by the Additional Junior Civil Judge, Husnabad. Subsequer tly, he has made severa-l representations seeking i ;suance of pattadar passbooks and title deeds. The pr: itioner had also hled online application No. 17O1OO6(1 392, dated '/'^\1 3
10.06.2025. Despite receiving and acloeowledgiqg the same, the respondents 2 &, 4 did not act upon the same. Aggrieved by the inaction on tJre part of the respondents 2 & 4, petitioner filed the present writ petltlon.

Whereas Sri L.Ravinder, Ilearned Assistant Government Pleader for Revenue, on instructions, would submit that the 4th respondent will consider the online application, if filed in accordance with the provisions of the Bhu Bharathi Act, 2025 arrd the Rules made thereunder, strictly ,in accordance wittr law.
5. In the light of the said submission, without expressing aly opinion on tlre merits or demerits of the case, liberty is granted to t.l:e trretitioner to hle appropriate F-line application in accordance with ttre provisions of Bhu Bharathi Act, 2025 and the Rules made thereunder. On filing such application, the respondents 2 to 4 are directed to consider the same \ 4 along with the online application of thr petitioner stated supra, strictly in accordance wi h law, by putting the petitioner and all e11r"r intere:r ted parties on notice and afford an opportunity of l.earing. He shall complete the said exercise within a 5 eriod of 45 working days from ttre date of receipt of a :opy of this order.
6. With th€ above direction, this Wril Petition is disposed of. There sha1l be no order as to :osts. As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
