3. I.A.No.1 of 2025, under Order XXIII Rule 3 read with Section 151 C.P.C., is filed seeking to dispose of the appeal in terms of the Memorandum of Understanding, dated 26.06.2025, entered into between the appellant/defendant No.3 and respondent Nos.1 and 2/plaintifls.

Whr:n the matter is taken up for hearing, learned counsel for the appellant/defendant No.3 and learned counsel for respondent Nos.1 ancl 2/plaintiffs had informed the Court that the issue raised in l_.,* AKSJ & VRKR,J A.S.No.673 of 2oll & batch the present appeal has been amicably setiled between the parties 2 and to that effect the appellant and respondent Nos.1 and 2 have entered into a Memorandum of understanding, dated 26.06.202s, which was annexed to I.A.No. t of 2025. Learned counset further contended that the appeal may be disposed of in terms of the Memorandum of Understanding, dated 26.o6.zozs, entered into between the appellant and respondent Nos.1 and 2.

5. The parties are present in the court and they are identified by their respective counsel. The appellant and respondent Nos.1 and 2 have stated before this Court that they have amicably setiled the dispute outside the court and they have entered into a Mernorandum of Understanding, dated'z6.o6.2ozs. Respondent Nos.3 and 4/defendant Nos.1 and 2 reported no objection for recording the compromise.

6. This court, having considered the said submissions, is of the considered view that the appeal can be disposed of in terms of the Memorandum of understanding, dated 26.06.202s, annexed to i I.A.No.l of 2025

7. Accordingly, I.A.No.1 of 2025 is allowed and the appeal is disposed of in terms of the Memorandum of Understanding, dated
