26.06.2024, for taking action for non-supply of CMR as pcr the agreement, u,hile W.P.No.31764 of 2024 and in W.P.No.19246 of 2024 arc filcd challenging the rejection of the petitioners' representations / replies for delivery of CMR, subsequent to the prescribed and extended date.

2. This Court, vide orders dated 22.07 .2024 in W.P.No. 19246 of 2024 and orders dated 13.1t.2024 in W.P.No.31764 of 2024 and orders dated 31.O7.2024 in W.P.No.20594 of 2024, had granted interim direction not to take any coercive steps against the petitioners herein.

3. The lcarned Government Pleader for Civil Supplies appearing for the respondents has filed a counter affidavit giving the reasons for taking steps against the petitioners and further stated that even after lapse of the time extended by the Government lor delivery of CMR rice and in spite of the assurance given by the petitioners in the writ afhdavit that if time is given, they rvould supply the CMR rice within the extended time , no steps have been taken by the petitioners to E honour the same. It is further submitted that as on today also, the instructions to the Government Pleader for Civil Supplies are thar the petitioners have not supplied the CMR rice and therefore, the department is suffering huge loss.

4. It is noticed that the petitioners have not fiied any rejoinder to the counter affidavit rebutting the contentions of the department.

5. In view thereof, this Court is inclined to vacate the interim orders and permit the respondents to take steps in accordance with law and also in accordance with the terms and conditions of the CMR agreements.

6. With these directions, all the writ petitions are disposed of. There shall be no order as to costs.
