Thcse appeais have been filed by different claimants dissatislied rvith the inadequate enhancement of the market value in their respective petitions filed before the reference court in respect of the acquired lands. Hou'ever, it is to be seen that all the petitions filed by the claimants before the reference court 2 AKS,J & VRKR, J LAA5_6_2o11 batch i \;\t'=l \ are arising out of the same Award vide No.38/ 1993 dated

30.1O.1993 passed by the Land Acquisition Officer in respect of the lands of the claimants situated Venkatapur Village of Pebbair Mandal and the grounds raised by the claimants in all these appeals are also one and the same-

3. For the sake of convenience, hereinafter the parties will be referred to as per thqir array before the reference Court.

4. The brief facts of the case as can be seen from the record available before this Court are that the lands belonging to the appellants/claimants situated in Venkatapur Village of Pebbair Mandal were acquired by the Government for the purpose of left main canal under Priyadarshini Jurala Project. In this connection a notification under Section 4 (1) of the Land Acquisition Act, 1894 (for short 'the Act") was published on

19.04.1993 .and whereas the possession of the lands were taken on 30.03.1991. The Land Acquisition officer grouped the land into following three categories: Categotr - I: i) Wet lands having assured source of irrigation under Rangasamudram Tank of Srirangapur; Categorv - II: ii) Dry land in Sy.No.247 having well water source of irrigation; 'I -J J AKS,J & VRKR, J 1.4A5_6 2o1l bbtch Categorv - III: iii) Dry lands.

5. The Land Acquisition Officer passed the award on

30.10.1993 under Section 11 of the Act. Based on the sale deed dated 27.O5.1992, the Land Acquisition Officer fixed the market value at Rs.24,000/- per acre for the lands under category - I. Based on the sale deed dated 04.08. L992, the Land Acquisition Off,rcer hxed the market value at Rs.20,000/- per acre for ttre lands under category - III- By allowing Rs.2,OOO/- towards developmental charges, the Land Acquisition Offrcer fixed the market value at Rs.22,O0O/- per acre for the lands under category - II. The Land Acquisition Officer fixed the values for well dug in Sy.No.22O and 2I9 and pipe line laid in Sy.No.247 (1.D.) as per the values of the struchrres furnished by the E.P.P.J.P.L.C.C., Division No.ll, Pebbair apart from allowing compensation for trees. 6- Challenging the fixation of market value for the lands acquired, the appellants/claimants frled their respective claim statements with a prayer to refer the matter to the reference court under Section 18 (2) of the Act for enhancement of compensation of acquired lands i.e., from Rs.24,OOO f - per acre to Rs.1,OO,OOO/- per acre in respect of lands falling under 4 AKS,J & VRKR, J LAAS_6_2o13 bat(h category - I, from Rs.22,OO0 /- pe, acre to Rs.8O,OOO/- per acre in respect of lands falling under category II and from Rs.20,0OO l- per acre to Rs.5O,00O l- per acre in respect of lands falling under category - III. The sum and substance of the claim statements submitted by the claimants is that the land acquisition officer arrived at the fixation of the market value for the lands by discarding the favourable points to the owners o[ the lands and considered the points arbitrarily for the purpose of reducing its value. The lands yielded paddy crop for every season for 4O to 5O bags in average for two seasons and it went up to 8O to 100 bags per year and thus, the net value of every crop for every season after deducting the investment expenses is to be Rs.S,OOO/- and for two seasons Rs.1,O0,OO0/- per year- As per the Act and the relevant Rules, the value of each acre of wet land categoriznd under category-I -has to be assessed at Rs.1,OO,OOb l- per acre. While assessing valuation for any land, all the three modes viz., expert opinion, comparable sales of similar lands and also the capitalization method are to be adopted simultaneously. Regarding lands falling under category II, there is an open well costing about Rs-1,OO,000/-, and in addition to that, the claimant has drilled three in-well bores and improved the water potentiality and installed electricity motor to (Y 5 AKS,J & VRKR, J tAAS_6_2orl batth tl:e source. The Land Acquisition Officer did not take into consideration tJ.e potentialities of the acquired lands while fixing the market value. While opposing the claim of the claimants, the Land Acquisition Officer filed separate reply statements and the sum and substance of all the reply statements is that the lands were categoriz,ed into three categories by taking into all aspects as per Chapter X Part 3 of L.A. Manual. For determination of market value, the sale transactions which took place during statutory period of preceding three yezrrs to 25.04.1993 has to be taken into account. As regard land in Sy.No.247 admeasuring Ac.7.25 guntas, categorization as I.D. is quite justifiable. The land was recorded as dry land in revenue records but it was cultivated with well water existed in the same survey number through pipe line. The land was being cultivated witJl groundnut i.e., irrigated dry crops.

8. The matters wei'e referred to the reference court, wherein the claimants filed a Memo dated 21.09.1998 with a prayer to club all the 29 cases so as to dispose of the same by way of a common order in O.P.No.136 of 1995. 6 AKSJ & VRKR, J LAAS_6_2o1J batch

During the course of enquiry, on behalf of the claimants PWs 1 to 5 were examined apart from marking Exs.Al to A1O and whereas the Special Deputy Collector, Land Acquisition Unit was examined as RWl to establish that the market value fixed by the Land Acquisition Officer is reasonable and got marked Ex.Bl on his behalf. After considering the oral and documentary evidence adduced on behalf of either side, the reference court enhanced the market value only in respect of lands falling under category - I from Rs.24,0OO l- per acre to Rs.4O,O00 l- per acre. Having dissatisfred with the fixing of market value of acquired lands, out of 29 cases, only the claimants in 14 cases have preferred the present appeals for further enhancement of market value in respect of acquired lands.

10. Heard Sri S. Venkateshwar Reddy, learned counsel on record for the appellants and learned Government Pleader for Appeals for the respondent in all the appeals and perused the record. 11 Now the point for determination is: Whettrer there €rre zrny substantial grounds to interfere with the impugned common order dated 19.1O.20OO i-\- - \. &., (l 7 AKS,J & VRKR, J LAAS_6_2o13 batth passed by the learned Senior Civil Judge, Wanaparthy in O.P. No.136 of 1995 and batch of cases? L2. PTOINT: Admittedly, the Land Acquisition Officer categoriznd the land into three categories for fixing the market value, for which the claims reported no objection in their claim statements. However, it is the contention of the claimants that the Land Acquisition Officer categoriznd the land into three categories for fixing tl.e market value without taking the assistance of expert. As stated supra, the lands under acquisition were categorjtzed into three categories by taking into all aspects as per Chapter X Part 3 of L.A. Manual. Thus, it is amply clear that the Land Acquisition Officer has categonzed the lands into three categories by following ttre due procedure. Once the claimants reported no objection for categorizing the lands into three categories and since the Land Acquisition Officer had followed the due procedure in categorizing ttre lands, it is immaterial as to whether the Land Acquisition Officer had taken the assistance of expert for categorizing the lands into three categories.

13. The first and foremost contention of the learned counsel for the claimants is that the reference court ought to have seen that tl.e acquired lands are black soil and potential lands 8 AKS,J &VRKR, J tAAS_6_2orl batch having permanent source of irrigation and claimants/appellants were raising commercial crops and getting net income of Rs.6,0OO/- per acre. L4. A perusal of the chief examination dated 31.o3.L999 deposed by PWl discloses that the claimants used to get an approximate yield of 1O quintals of groundnut and cotton per acre and the income thereon was Rs.1O,OOO/- excluding expenses. He further deposed that on sohamasuri paddy, they were getting 32 quintals per acre on which the income was Rs.lO,oOO/- excluding expenses. He further deposed that on sunflower, they were getting L2 quintals per acre and the income was Rs.8,OOO/- per acre excluding expenses. Thus, it is clear that the evidence of PWl is exaggerating so far as the income derived by the claimants on rai:sing commercial crops' The claimants further relied upon Ex.A4 i.e., price list of commodities of agricultural market committee, Wanaparthy pertaining to the years l99t-92 and 1993-94. However, PWs, who is the Supervisor of Agricultural Market Committee, wanaparthy, deposed that the agricultural produce of all tl.e neighbouring mandals are brought to their market, at Wanaparthy Town for sale. He further deposed tleat as the vt- maximum and minimum rates of ttre commodities are shown in t- I AKS,J & VRKS J |-A45_6_2o13 batch Ex.A4, he cannot say the rate of the commodities of a particular village. Though the claimants relied upon Ex.A4 to establish the annual yield earned by them in respect of the acquired lands, through the evidence of pws, it is elicited that it is not possible to ascertain the rate of commodities of a particular Village.

The other contention of tl.e learned counsel for the claimants is that the reference court ought to have seen that the lands are situated towards pebbair village and that earlier the Court fixed compensation @ Rs.7O,OOO/- and Rs.75,0OO /_ per acre for the lands acquired at pebbair Village and that the lands of Janampet Village and lands of pebbair Village are similar and contiguous shivars. It is to be seen that though pwl (claimant in o-P-No-136 of 199s) denied the suggestion given by the learned counsel for the respondent that their village venkatapur is at 8 K.Ms to Pebbair, he admitted in his cross examination that their village venkatapur is at 3 K.Ms to pebbair and that both t]:e village limits are at a distance of 2 K.Ms. pw4 in his evidence deposed that the wet land covered under Ex.A6 is at six furlongs to Venkatapur Village. Apart from that, pwl admitted in his cross examination that besides Ex.A6 transaction, many registered sale transactions took prace in I I 10 AKS,J &VRKR, J [AA5_6_2013 batch their village Venkatapur during relevant period- There is no explanation on the part of claimants, as to why they could not 'file t]le proof of available sale transactions in ttreir village Venkatapur rather than depending on the sale transactions that took place in Pebbair, which is far away from Venkatapur. Therefore, the above conteltion of learned counsel for the claimants is unsustainable.

The further contention of learned counsel for the claimants is that the reference court ought to have seen that the courts at wanaparthy and Gadwal had consistently granted Rs.6O,OOO/- to Rs.1,OO,OOO/- per acre for all the lands acquired for the purpose of P-J.P. canals irrespective of location. It is further contended that the reference court erred in discarding all the documents without any basis and valid reasons.

There is no dispute with regard to Exs.Al to A3, which are pahanies that disclose the nature of land, extent of lands in each survey number of the village, crop pattern, details of crops etc. One of the documents, upon which the claimants are relying, is Ex.A6, which was marked through PW4. In fact, the Land Acquisition Offi,eeldid not consider the said document while fixing the market value on the ground that the sale item \ II AKS,J & VRKR, J tAAS_6_zor3 batch Nos.9, 1O and 28 (Ex.A6 sale) are combined sales for the wet and dry lands. In this connection, PW4 admitted in his cross examination that the dry land is uncultivable, useless and the purchasers were not willing to purchase the dry land and thus, he refused to sell the wet land unless the purchasers purchase the dry land. However, the reference court observed in the impugned order that once sale is not a combined one, it is not open for the land acquisition oflicer to treat it as a combined sale. A perusal of Ex.A6 sale deed, dated O5.O2.1992 discloses that the lands in Sy.Nos.2l7 and 218 wherein were wet lands were sold at Rs.50,000/- per acre and whereas the land in Sy.Nos. 224, 237 and 238 which was a dry land was sold at Rs.4,OOO/- per acre. Apart from Ex.A6, the claimants have placed their reliance on sale deeds under Exs.AS and A7, whereunder the dry lands situated in adjacent villages i.e., Chelimilla and Srirangapur were purchased at Rs.41,2OOl- and Rs.50,O0O /- per acre respectively. But it is pertinent to note tlrat the iands in respect of Exs.AS and AT are situated in Chelimilla and Srirangapur Villages respectively which are different from Venkatapur Village. As rightly observed by the reference court in the impugned order that nothing has been C} t2 AKS,J &VRKR, J l-AA5_6_2013 batch produced by the claimants to show that the limits of chelimilla and Srirangapur adjoin Venkatapur Village limits.

The reference court observed in the impugned order that as per Section 24 of the Act, the court shall take into consideration the market value of the land as on the date of notification under Section 4 (1) of the Act. However, the reference court relied upon decision of this court in C. Dharmapal Reddy v. R.D.O-l, wherein similar issue was considered by this court and held that escalation of prices from time to time, which may reasonably be taken at L2oh to 2Oo/o pet annum for fixing market value. In the present case, Ex.A6 sale took place on O5.02.L992 and whereas the draft notification under Section a (1) of the Act was published on 19.04- 1993 and thus, there is a time lag of L4 months between the two' Therefore, the reference court while discussing about the sale consideration covered by Ex.A6 recorded a finding that the lands under Ex.A6 are adjacent to the land under acquisition which is proved by examining PW4, who is the vendor of tl.e subject lands. !.\.

The reference court also considered the income received from the lands which are acquired by raising paddy and ' 1998 (U ALT47 (DB) b" l3 AKS,J & VRKri, J LAAS_6_2o11 batch groundnut etc and that PWI deposed that the claimants were getting net income of Rs.1o,ooo/- by growing such crops in the said lands. Therefore, the Land Acquisition officer observed that even taking into consideration the capitalisation method, ' the nature of the lands and the crops being raised therein and the orai evidence let in by the claimants to show the yield of respective crops raised on the wet lands, which has been proved by producing Exs.Al to A3 pahanies. Thus, the reference court found that the crop yields cannot be less than Rs.4 ,ooo/- per acre in as much as the crops raised are paddy and groundnut. The reference court while relying upon the decision of the Apex court in state of Haryana v. Gurucharan singh2, wherein it was held that the multiplier could be at least .12, and taking the same into consideration the reference court fixed the multiplier of '10'and multiplied it with crop yield per acre of Rs-4,ooo/- under capitalization method which comes to near the value as mentioned in Ex.A6 sale dbed for the wet land. Thus, keeping in view of various attending circumstances, the reference court frxed the market value @ Rs.4o,ooO/- per acre by considering the potentiarity of the land and its location and the net income derived from it. r atR 1996 sc 106 t, n t4 AKs,J & VRKR, J LAAS_6_2013 batch

Though the claimants relied upon Exs.A8 and A9 i.e', the certified copies of the judgments, wherein the court enhanced the market value in respect of acquired lands, they are situated at Pebbair, which is far away from Venkatapur, wherein the acquired tands in the present appeals are situated. Though the value of tl.e dry land under Ex.A6 is valued at Rs'4,OOO/- per acre, the Land Acquisition Officer fixed the market value at Rs.22,OOO l- per acre in respect of lands falling under category - II and Rs.2O,OOO/- per acre in respect of lands falling under category - III. Perhaps for the said reason' as to why the reference court did not venture to further enhance the market value in respect of lands falling under categories - II and III. In view of the above discussion, the above contention of the learned counsel for the claimants that all the documents relied upon by the claimants were not taken'into consideration and the same were discarded by the reference court, is untenable. 2I. In the light of the fbregoing discussion, this court is of the considered view that the appellants have failed to make out any ground warranting interference with the well reasoned findings recorded by the reference court.
