SREENIVAS RAO CIVIL REVISION PETI TION No. 35o9 of2O24 ORDER: This civil revision petition is hled invoking the provisions of Article 227 of the constitution of India, aggrievecl by the order dated 28.O8.2024 passed by the Principal Junior Civil Judge cum-Judicial First Class Magistrate, at Medak, (for short' 'the trial Court') in I.A.No.185 of 2023 in O.S No'376 of 2023' whereunder the application [rled under Order XXVI Rule 9 of the Code ol Civil Procedure' 1908 (hereinafter referred Lo, as 'the C P C ) secking appoinLment of thc Advocate Commissioner is dismissed

The revision petitioners are the plaintiffs and they fiied suit in O.S.No.376 of 2023 before the trial Court secking (i) to pass judgment and decree in their lavour directing the defcndants to deliver the possession of the suit schedule property to an extent of Ac' 1 26 gts situated at Ramayampet Village and Mandal' Medak District; (ii) to appoint Advocate Commissioner for demarcalion of the suit schedule lands of the plaintiffs and defendants with the help of concerned Surveyor and; (iii) to grant a decree for perpetual injunction restraininflttle defendants and their henchmen' wo:Ua:t' servants' ' 2 etc., from r ()1. rlienating, selling or mortgaging tO a tnir.r I party with respect to tl e ,srLit schedule property.

Having considered the rival submissions made by the respectrve parties and after perusal of the material available on record' it reveals that the petitioners filed suit for recovery of possession in respect of the suit schedule property and they also sought for appointment of the Advocate Commissioner to demarcate the suit land o[ the petitioners and respondents with the help of surveyor' When the suit is pending, the petitioners hled application i e'' I'A'No 185 of 2023 ' for #fr"g appointment ol Arlvocate Commissioner to survey the land and llx the boundaries. The relief sought in the application and the relief sought in the suit for seeking appointment of Advocate Commissioner for demarcation of the suit schedule property is one and the same.
