Counsel for the Petitioner: SRI K.PRADEEP REDDY n counsel forthe ReSpondents: AGP FoR REVENUE I The Court made the following: ORDER l I ,7 THE HON'BLE SRI JUSTICE C.V.BTIASI(AR REDDY WRIT PETITI oN No.3O522 of2024 ORDER: This writ petition has been hled seeking to declare the action of respondent No.2 in not considering the Dharani Application No.2400055589 dated O8.O7'2024 submitted by the petitioner seeking correction of entries in the Dharani Portal in respect of land admeasuring Ac'0'20 grrntas in Survey No.76l3/2 situated at Pudur Village iand Ma;rdal, Vikarabad District, as patta land which was wrongly entered as Lavuni patta inspite of Mdmo dated 07.06.2024 vide No.E2l5812O20 issued by respondent No.2 wherein it was directed to treat the land admeasuring Ac.4.35 guntas in Survey No.76 situated at Pudur Village and Manda-l, Vikarabad District as patta land and to delete the same from the 22-A list, as illegal and arbitrary and for other appropriate reliefs.

It is stated that the petitioner is the absolute owner and possessor of agricultural land admeasuring Ac'O'20 guntas in Survey No.76/3 situated at Pudur Village and 2 \ Mandal, Vikarabad District, having acquired the same from his father by way of succession vide proceedings No.B/23O8/2016 C-ated i3.07.2016. It is stated that he has been issued nerv pattadar pass book vide patta No.1219 wherein the nature of land is wrongly mentioned as assigned land. It is stated that even though the nature of the subject land has been classified in all the revenue records as patta land, the respondent authorities without taking them into consideration, have not only wrbngly mentioned the classification of the subject land in the pattadar pass book as assigned land but also i6cluded the entire land admeasuring Ac.4.35 guntas in Survey No.76 in the 22-A register without issuing any notihcation or proceedings, '"vhich constrained the petitioner to submit application dated 17.ll.2023 on the file of respondent No.2 rvho in turn made enquiry and issued a Memo dated

07.06.2024 vide No.E2l58/2O2O directing respondent No.3 herein to talie necessary action for deleting the lands in Survey No.76 from 22-A register by treating the same as patta land. The grievance of the petitioner is that despite the same and even though he submitted application in 3 Dharani portal on 08.07.2024 vide Application No.2400055589 seeking to change the nature of subject land from sarkari to patta and'to delete the same from 22- A register, so far no action has been taken thereon.

A counter affrdavit has been filed by respondent No.5 i.e., the Tahsildar, Pudur Mandal, Vikarabad District, inter alia stating that acting upon the application of the petitioner, enquiry was conducted and on verification of records, it was revea-led that Survey No.76 to an extent of Ac.4.35 guntas is recorded in the revenue records as patta land from the pahanies for the year l97O-71 to till date ! and as such the application of the petitioner was duly recommended and forwarded by respondent Nos.3 to 5 to the District Collector, Vikarabad i.e., respondent No.2 herein and the same is pending for approval.

In view of the above and since it is specihcally stated that the petitioner's application has been acted upon by respondent Nos.3 to 5 and the sarne is pending for the approval of respondent No.2 for re-classificaLion of the subject land as patta land, the writ petition is disposed of , I I I \ 4 by directing respondent No.2 to pass necessaqz orders of approval in accordance with law and thereafter, respondent No.5 shall make necessary corrections in the revenue records by changing the classification of ttre subject land as patta land and issue amended pass books in favour of the petitioner. The aforesaid exercise shall be completed rvithin four weeks from the date of receipt of a copy of this order. Pending miscellaneous applications, if any, shall stand closed.
