Respondents ORDER: The petitioner submitted an Online Application (No.HY1074765178522 dated 14. 11.2022) seeking renewal of his Passport bearing No.K824365 I, however, the respondent-passport authority has refused to renew the passport on the ground that the petitioner is facing criminal proceedings in C.C.No.3 194 o12022 on the fi[e ofAdditional Judicial Magistrate of First Class, L.B' Nagar, lor the offences punishable under Sections 406, and 420 IPC.

2. Heard Mr. K.L.B. Kumar, learned counsel for the petitioner; and learned Standing Counsel for the Central Govemment. Perused the record.

3. At the hearing, both the leamed counsel submit that the present writ ; petition is covered by the Order dated 03.09.2025 passed by this Court in / W.P.No.24690 of 2025. - '-- \ I t

Considering the respective submissions, this Co rft directs the 2n'r respondent-passport authority to consider the Online App cation filed by the - petitioner on the following conditions: - . --,-*-1 i) The petitioner herein shall submit an undertakiri along with an affidavit in C.C No.3194 of 2O22, pending on thefile of Arl, rtional Judicial Magistrate of First Class, L. B. Nagar, statrng that he shal rot leave lndia during pendency of the said C C., without permission of thl Court and that he shall cooperate with trial Court in concluding the procee3 ngs in the said C,C.; ii) On filing such an undertaking as well as affidav t the trial Court shall issue a certifled copy of the same within two (2) weeks therefrom; iii) The petitioner herein shall submit an application ir' 'esh along with certified copy of this order as well as the aforesaid undertl ling before the Passport Officer / Authority concerned for renewal of passp < .t; iv) On frlrng such an application. the Passport Office. Authority shall consider the same afresh in the light of the observations mirr e by this Court herein as well as the contents of the undertaking given by tl e petitioner for issuance of renewed passport, in accordance with law, rv:hin three (03) weeks from the date of said application, v) Respondent No.2 shall consider Rule 12 of the t assport Rules, '1967 while considering the aforesaid application submitted c , the petitioner, vi) On issuance of the renewed Passport, the petito ler herein shall deposit the same before the trial Court in C.C. No.3194 of 2 ( 22, pending on the file of Additional Judicial [\ragistrate of First Class, L.B. I agar; and vir) However, liberty is granted to the petitioner r:rein to fite an application before the leaned Magistrate seeking pern i ,sion to travel abroad, and it is for the learned Magistrate to conside the same in accordance with law.
