2. Heard Ms.Unnam La'"r' Firm, learned counsel for petitioner and learned Standing Counsel for Central Government, for respondent Nos. 1 and 2. Perused the record.

3. Learned counsel for petitioner submits that mere arraignment of the petitioner in a criminal case cannot be a ground for denial of passport. He relies on the judgment of this Court in W.P.No.24690 of 2025, dated 03.09.2025.

4. Learned Standing Counsel for the respondents submits that criminal case is pending against the petitioner uide C.C.No.384 of 2024 before the Iearned I Additional Metropolitan Magistrate, Medcha,l- Malkajgiri District, at Kushaiguda. It is submitted that the respondent authorities would consider the petitioner's application for a period of one vear only, if he obtajns permission to \Bii. \\ {, l97L)9 l(ili trai el abroad from tlrc court u'here the crimir rl c ase is pending against him 5- Be that as rt mar, consiclering the judgmer r ol' the coordinate Bench of Lhis Court in W.P.No.2,1 154 of 2025, :lrrtecl 03.O9.2025, and the purpose for u'hicl-r the passport is beinrl requested by the petitioner, this Court rlirects the respondent 'Jo.2 to issue the passport to the petitioncr on the follor.ving condirnrrs: i) The petitioner herein shall submit an urrclertaking along with an alfidavit in C.C.No.384 of 2024, pendir g on the file of learned I Additional Metropolitan Magistrate, Me lc hal- Malkajgiri District, at Kushaiguda., stating that he shall not leave India during pendency of the said C.C., without permis:ri<>n of the Court afld that he shall cooperate with trial Court in r:oncluding the proceedings in the said C.C; ii) On filing such an undertaking as well as affidavit, the trial Court shall issue a certifred copy of the san.c u/ithin two (2) weeks therefrom; iii) The petitioner herein shall submit ;rn application afresh along with certified copy of this order z.s well as the aforesaid undertaking before the Passport Offi:er / Authority concerned for issuing the passport; iv) On filing such an application, the Prsrsport Officer/ Authority shall consider the same afresh in thr: light of the observations made by this Court herein as well as the contents of the undertaking given by the petitioner for issuielJ the passport, in accordance with law, within three (O3) weeks :iom the date of said application; v) Respondent No.2 shall consider the P;rssport Rules, 1967 while considering the application for r:newing of the passport to the petitioner; wil The competent authority shall specify the permission period of one year for the petitioner to renew the passport for travelling abroad, and also obtain appropriate unciertaking from the petitioner stating that the petitioner shall rot overstay the permitted period and shall surrender the passpor, upon return to India. vii) Any other condition as deemed apprc'priate by the trial Court. \OK.J \\P 19,'r)9 l0li
