Petition Under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith' the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamri. i; to declare the inaction on the part of the Respondent Police in registering the complaint given by the employees of the petitioner society dated 11.07.2025 by investigating the same for the offences of trespass, extortion, criminal intimidation and destruction of material in the office of the petitioner society and forcibly collecting rents from the tenants of the petitioner society by issuing fake receipts in the name and style of Arya Vysya Sangham (Pattana) / warangal, (Parirakshana Adhoc committee) .and in furthe r not registering and investigating the complaint given by the petitioner (depon -. rt) on 06.08.2025 for the similar offences committed in the same manner by t e sari offenders, as illegal, arbitrary, unjust apart from being violative of princil les of natural justice and against the mandatory provisions under sec.'173 of t re Btiaratiya Nagarik suraksha sanhita, 2023, and ii) to consequenfly direct the lespondent police to register two separate crimes on the basis of the compl;r rt dated 11.07.202s given by the employees of the petitioner society and he complaint dated 06.08.2025 given by the petitioner (deponent) by inves;l gating the same in accordance with the law by taking appropriate action in acc. cance with law. |.A.NO:1 OF 2025 Petition Under Section 151 cpc praying that in the c r ;umstances stated in the affidavit filed in support of the petition, the High cour may be pleased to direct the Respondent Police to register the crime pursuant :r the complaint dated 11 .o7 .2025 given by the employees of the petitioner soci() y and the complaint dated 06.08.2025 given by the petitioner (deponent) by i., estigating the same and taking appropriate action. Brref facts of the case are that the retitioner being represented by its president would submit tlLr is a society registered under the provisiotr t the petitioner r of Telangana Societies Registration Act, 1953 ulde Regist ation No.28 of 1953 and is running its activities in its ou,-r, building in the name and style of Vysya Bhaval of Arya \ (Pattana), Waralgal. Apart from running 1 ysya Sangham re day to day activities of the socieiy in the said buildin g , portion of the building is 1et out to vario running business and that the rents co11e the remaining rs tenants for :ted from the tenants, are being used for thc welfare of thr: society and its members. It is submitted that certain membcr s of the society in coliusion with others are trying to occupy 1 re premises of the society building located at H.No.g-2_98, /ysya Bhavan, R.N.T. Road, Warangal. It is further submiit rd that in the absence of petitioner, on 1 I .O7 .2025, one Gora rtala Yadagiri, Pulluru Madhu, Thota Vydyanath, Dhidura i Pulluri Vimala, Vallala Shailaja and some trespassed into the society building and he Anjani Devi, others have ue closed the carnera surveillance by capping the camere folders and destroyed certain furniture . s w'ith paper nd materials pertaining to the society and threatened the err pioyees of the i ., society as well as forcibly extracted money from the tenants of the premises claiming to be the representatives of the Society. Later once again on 06.08.2025, the above persons along with other unsocial elements again illegally trespassed into the society building and further collected rents from the tenants and gave fake receipts dated 31.07 .2025. The employees of the petitioner's societlz gave a report to the respondent No.5 on 11..07.2025 itself, however, the police did not act upon the same, the said report was sent by Boliam Sarangapani and others by Registered Post to the respondent police, however, no action has been taken. The petitioner has given a complaint to the respondent No.5 on 06.O,8.2Q25 and till date no action has been taken on the said complaints dated 11.O7.2025 and O6.08.2025. Questioning the same, present writ petition is frled. Learned Assistant Government Pieader for Home 4 appearing for respondents submits that to the extent of complaint before the respondent No.5, appropriate orders to be passed. -8'. Having considered the aborre facts and circumstances, and without expressing any opinion on the merits of the case, this writ petition is disposed of directing the resPoldent No.S ;r.:l 4 \'.'E to consider the complaints of the petitioner c ated 1 r.oz.2o2s - and 06.08.2025 and take appropriate e r tion strictly in accordance with law.
