Azad Chendra Shekar Counsel for the Respondents: None Appeared The Court made the following: COMMON ORDER TIIE HON'BLE JUSTICE MOUSHTIMI BTIATTACTIARYA CI.L REVISION PETITION Nos.3576 AND 3579 OF 2025 Mr. J Azad Chendra Shekar, leamed counsel appearing for the petitioners COMMON ORDER: 1- Both the CRP's arises out of a common order dated 29.08.2025 wherein the learned II Additional District and Sessions Judge, Medchal-Malkajgiri has dismissed the I.A.Nos.SO7 and 508 of 2025 in O.S.No.1O9O of 2015 frled by the petitioners for further cross examination and reopening of the evidence o[ DWl/defendant No.5. The Suit was fiIed by the petitioners / plaintiffs in the year 2O15 lor partition and permanent injunction.

2. It is the admitted case of the petitioners that thc petitioners have filed two LA's in August, 2025 i.e., after delay of ten (1O) years I 't after hling of the Suit, for the relief as stated above.

3. Although learned counsel appearing for thc petitioners submit that the Trial Court has failed to note that the pelitioners had \ mentioned hling of the two I.A's in the year 2O24, this Court finds tha[ the reasons given by the Trial Court extended beyond such suppression. The Trial Court records that the petitioners had earlicr filcd a similar application for the same relief i.e., for cross cxamination of DWl and the defendants were recalled and despite giving sulficient opportunities and adjournments to the pctitioncrs and afLer allowing the said I.A's, the petitioners had failed to cross examine DW 1 . The Trial Court accordingly found that the petitioners had suppressed the I i I I i i 2 ,/-., fact of the second I.A. being hled for the same re ief and also that the petitioners had not shown any bona fid.eness of iling of second set of I.A.

4. The Court has perused paragraph No.4 of the affidavit hted by the petitioners in I.A.No.SOS of 2025, which rr: rntions filing of the earlier re-opening petition in 2024 and the sa ne was allowed on 21.08.2024. The affidavit however does not merL ion the fact that the petitioners failed to cross examine DWI J:spite being given opportuni[ies and granted adjournments in that r spect. 5. [{ence. this Corrrt does not hnd €rny error n the reasons given by the Trial Court, nor do we find any scoF: for setting aside impugncd order dated 29.O9.2O25, by which the l etitioners [.A,s r.verc dismissed.
