We have heard learned counsel appearing for the petitioner and learned counsel appearing (complainant before the responden lor the respondent No.4 lt No.3/ District Consumer Disputes Redressal Commission-lll, H' [derabad).

2. No one appears for the responde nt No.5.

3. A Co-ordinate Bench passed an interim order dated

04.11.2024 directing the Executrng C f ourt not to proceed further without the leave of this Court

4. We are informed that the e' [idence of the respondenl No.4/complainant has concluded an ld the petitioner is due to commence its evidence before the respondent No.3/ District Consumer Disputes Redressal Commis Hsion-III.

5. We are satisfied that there is no basis to continue the interim order since contrary to th [e submissions made, the petitioner's name rs clearlv reflected in the License Agreement executed between the petitioner an I the respondent No.4 on a O1.I2.2O23. The petitioner,s claim that the Agreement was executed between the respondent No.4 and the respondent No.5 in personai capacit5r is hence contrary to the records. Additionally, the petitioner's case in the FIR contradicts the p()sition taken by the petitioner n the Writ petition.

6. We are, therefore, of the considered vierv that nothing further remains of the writ petition and the pa:ties should be relegated to the District Consumer DisptLtes Rcdressal Commission-Ilt, Hyderabad, where the trial is prescntly ongoing.

7. W.P.No.ito109 of 2024, along with all connected eipplications, is, accordingiy disposed of in terms ol the above. The interim order ,1ated 04.11.2024 is vacated. There shall be no order as to co'sts.
