JUSTICE SUREPALLI NANDA WRIT PETITION o.3OO28 ot 2024 ORDER: Heard Sri Venkata Raghu Mannepalli, learned counsel appearing on behalf of the petitioners, Sri Gadi Praveen Kumar, learned Deputy Solicitor General of India, appearing on behalf of respondent No.1, learned Assistant Government Pleader for Social Welfare appearing on behalf of respondent No.2, learned Assistant Government Pleader for Municipal Administration Urban Development, appearing on behalf of respondent No.3 and learned Assistant Government pleader for General Administration, appearing on behalf of respondent No,4.

The as under: titioners aooroached the Court seekino oraver "...to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.2 in not considering the Represent,ations dated 25.04.2024 and 27.09.2024 in pursuance of the Order passed by this Hon,ble High Court'in \/V.P.No.461O of 2024, dated 01.04.2024 as illegal, arbitrary and in violation of principles of Natural lustice and in violation of Articles 14, 16, L9,21 and 300-A of the Constitution of India, consequenUy direct the resporrdent No.2 to consider the Representations dated 25.04.2024 and 27.09.2024 in pursuance of the 2 Order passed by this Hon'ble High Court in W.P.No.4610 of 2024, dated 01.04.2024 and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The case of the petitioners in brief is that, the petitioners representing the Shia Civil Council for Social Justice filed a Writ Petition No.4610 of2024, seeking prayeras under:- "to issue a writ order or direction more particularly one in the nature of Writof Mandamus declaring the action of the respondents in not considering the Letter No 11081/53/02124 Dated 03.02.2024 filed by the petitioners as illegal arbitrary and in violation of Principles of Natural Justice and in violation of Articles !4, !6, 19, 21 and 300A of the Constitution of India consequently direct the respondents to consider the Letter No. 110-81/5)/02/24 Dated 03.02.2024 filed by the petitioners and to pass.." This court vide its order dated 01.04,2024 passed orders in W'P No. 4610 of 2024 observing as under: "The Writ Petition is accordingly, disposed of directing the znd respondent to consider the letter dated 03'02'2024 submitted by the petitioners and takenecessary steps in accordance with law. No costs"' 3 Subsequent to the orders dated 01.04.2024 passed orders in W.P No. 461Cr of 2024, the 2nd respondent failed to consider the letter dated 03.02.2024. Aggrieved by the same, the petitioners submitted representation letters dated 25.04.2024 and 27.09.2024 to the 2nd respondent and to the Hon,ble Chief Minister of State of Telangana. However, the said representations,lre not considered till date. Aggrieved by the said inaction of the respondents in not considering the petitioners repres;e ntatio ns, the present Writ petition is filed.

This Court vide its orde rda ted 04.11.2O24 oassed in favour of the Detitioners observ lnq as interim order u nder: "Heard the learned counsel appearing on behalf oF the petitioners, Sri Gadi praveen Kumar, learned Deputy Solicitor General of India, appearing on behalf of respondent No.1, learned Assistant Government Pleader for Social Welfare appearing on behalf of respondent No.2, learned Assistant Government Pleader for Municipal Administration Urban Development, appearing on behalf of respondent No.3 and learned Assistant Government pleader for General Administration, appearing on behalf of respondent No.4. Notice before admission. t t- c 4 The respondent No.2 is directed to consider the representations of the petitioners dated 25-04'2024 which has been acknowledged by the office of the 1st respondent on 26.04.2024 and another representation of the petitioners dated 27.09-2024 which has been acknowiedged by the office of the 2nd respondent on 27.09.2024 itselF pertaining to the request of the petitioners for nomination of the most deprived and politically disadvantaged Shia Muslim Community member in the Telangana Legislative Council under the Governor's Quota under Article 171(5) of the Constitution, within a period of four (4) weeks from the date of receipt of a copy of the order. List on respondents."

Taking into consideration the representation made by the learned counsel appearing on behalf of the petitioners, the Writ Petitaon is disposed of directing respondent No.2 to consider the representat'on of the petitioners dated 25-0,4.2024 which has been I 7 ) acknowledged by the office of the 1.t respondent on 26.04.2024 and another representation of the petitioners dated 27.09.2O24 which has been acknowtedged by the office of the 2nd respondent on 27,O9,2O24 pertaining to the request of the petitioners for nomination of the most deprived and politically disadvantaged Shia Muslim Community member in the Telangana Legislative Council under the Governor,s euota under Article 171(5) of the Constitution, within a period of four (4) weeks from the date of receipt of a copy of this order and pass appropriate orders on petitioners representations dated 25.04.2024 and 27-09.2024 in accordance to law and communicate the decision to the petitioners. However, there shall be no order as to costs.
