VIJAYSEN REDDY WR.IT PETITION No.28895 6 2tJ25 t ORDER: The writ petition is filed seeking a Writ of Mandamus lo declare the action of the respondents Nos.5 to 7 in interfering with the peaceful enjoyment of V.R.C. Godown in the house premises No.9-11415 in Sy.Nos.189 (Part) and 191 (Part) situated at Pedcia Amberpet Village, Abdullapurmet Mandal, Ranga Reddy District and trying to demolish the authorized V.R.C. Godown of the petitioners without issuing any notice and without following the due process oi iaw by colluding wlth the public representatives as iilegal, arbitrary, unconstitutional and violation of Articles t4, 15,21 and 300-A of the Constitution of India and also violation of principles of natural justice and consequently direct the respondent Nos's to 7 not to intert'ere with the peaceful enjoyment of V.R.C. Godown ano not to demolish the Godown without issuing any notice.

2. Heard learned counsel for the petitioners, Mr. Singiredr:y Ravinder Reddy, learned standing counsel for respondent No.5 - Municipality and learned Assistant Government Pleader for Irrigation and Command Area Development.

Learned standing counsel for the respondent No.5 and learned Assistant Government Pleader for Irrigation and Command Area Development. submitted that the godown of the petitioner is q { ') '\ in house premises No.g-114/5, Sy.Nos.189 (part) and 191 (part) situated at Pedda Amberpet Village, Abdullapurmet Mandal, Ranga Reddy District and is constructed in the FTL area of Chouta kunta Tank, Pedda Amberpet and as such, necessary action is being initiated ior removrng unauthorized construction.

4. In the circumstances, the respondents No.5 to 7 are directed not to interfere with the possession of the petitioners without following due process of raw. However, this order shafl not come in the way of the respondents No.5 to 7 in taking action against the petiticners bv giving prior notice, affording opportunity of hearing and pass orders, in accordar:ce with lay/.
