Judgment
Heard learned counsel for the petitioner and learned Government Pleader for Forests, appearing for the respondents.
Petitioner states that she is the registered owner of Mini Lorry bearing Registration
No.AP 16/XL 4752 and the said vehicle has been seized by the first respondent on 17-03-2005 on the allegation that the petitioner has committed certain forest offences by transporting red sanders logs without permission, which is in violation of the provisions of the Andhra Pradesh Forest Act, 1967 read with Rule 3 (1) (2) of Andhra Pradesh Sandal Wood and Red Sanders Wood Transit Rule of 1969. Accordingly, a notice dated 16-09-2005 was issued to the petitioner calling upon her to show cause as to why red sanders logs together with the aforesaid Mini Lorry i.e. AP-16 X 4752 should not be confiscated to the State as per law, and to submit her explanation within 15 days from the date of receipt of the said notice. The grievance of the petitioner is that though she filed representation on 19-08-2005, enquiry has not been completed and the said representation has not been disposed of so far.
Having regard to the facts and circumstances of the case, the second respondent is directed to complete the enquiry and pass appropriate final orders in accordance with law after giving reasonable opportunity to the petitioner within six weeks from the date of receipt of a copy of this order.
