This Criminal Revision Case is directed against the order, dated 12.08.2003, passed by the II Additional

Judicial Magistrate of First Class, Nellore, whereby C.F.No.3955 of 2003, a private complaint filed by the petitioner herein-complainant alleging the offences punishable under Sections 499, 500 and 501 IPC against respondents 1 to 7 herein-accused was dismissed under Section 203 Cr.P.C. Heard learned counsel appearing for the petitioner. Even after lapse of six years of filing this Criminal Revision Case, the notices are not served on the private respondents. The petitioner did not take any steps to see that notices are served on the private respondents. The present complaint was filed stating that the public notice published in Andhra Jyothi Telugu Daily Newspaper, dated 18.04.2003, in connection with a civil suit in O.S.No.52 of 1993 where the Senior Civil Judge, Nellore ordered substitute service, is defamatory and his reputation is spoiled in the society. In fact, the impugned order reads that the complainant was called absent and there was no representation on his behalf. Having perused the impugned order, this Court is of the view that the reasons recorded by the Court below for dismissing the said private complaint are justifiable and as such, the same do not warrant interference by this Court.
